ORDINANCE NO.
AN ORDINANCE, AMENDING CHAPTER 7, "ANIMALS
AND FOWL", OF THE CODE OF THE CITY OF FORT
WORTH, BY AMENDING SECTION 7-17 THEREOF,
CHANGING THE FEES CHARGED BY THE DEPARTMENT
OF PUBLIC HEALTH RELATED TO THE IMPOUNDMENT,
CARE, ADVERTISEMENT FOR SALE AND SALE OF
ANIMALS; DEFINING IMPOUNDMENT: AUTHORIZING
PUBLICATION IN PAMPHLET FORM: PROVIDING THAT
THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
OTHER ORDINANCES AND CODE PROVISIONS AND
REPEALING ALL PRIOR ORDINANCES AND CODE
PROVISIONS IN CONFLICT HEREWITH; PROVIDING P,
SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH:
SECTION 1.
That Chapter 7 of the Code of the City of Fort Worth, Texas
(1964, as amended, is hereby amended at Section 7-17 thereof,
and hereafter, Section 7-17 shall be and read as follows:
"Sec. 7-17. Poundage fees.
The following shall be the fees charged for poundage:
For taking up and impounding, per head $50.00
For taking care of animals per day, per head 5.00
For selling animals, per head 10.00
For preparing and posting advertisement
of sale 10.00
For newspaper advertisement. The actual
costs as determined from time to time;
and in the ev ent more than one animal
is advertised in the same advertisement,
the cost per head shall be divided equal-
ly among the animals sold or redeemed.
For purposes of determining these fees an animal
shall be considered impounded once it is rounded
up and in possession of the Department of Public
Health."
SECTION 2.
That the City Secretary of the City of Fort Worth is hereby
authorized to publish this ordinance in pamphlet form for
general distribution among the public, and this ordinance as so
published shall be admissible in evidence in all courts without
further proof than the production of said pamphlet, as provided
in Section 3, Chapter XXV of the Charter of the City of Fort
Worth.

SECTION 3.
That, should any portion, section or part of a section
of this Ordinance be declared invalid, inoperative or void for
any reason by a court of competent jurisdiction, such decision,
opinion or judgment shall in no way impair the remaining
portions, sections or parts of sections of this Ordinance, which
said remaining provisions shall be and remain in full force and
effect.
SECTION 4 .
That this Ordinance shall be cumulative of all other
ordinances and of the Code of the City of Fort Worth, except in
those instances where the provisions of this Ordinance are in
direct conflict with such other ordinances and such Code, in
which instances said conflicting provisions are hereby expressly
repealed.
SECTION 5.
That this Ordinance shall take effect and be in full
force and effect from and after the date of its passage, and it
is so ordained.
