HomeMy WebLinkAboutOrdinance 8818~, ~~ ~, ORDINANCE NO. ~ d ~~ AN ORDINANCE AMENDING CHAPTER 11, "CARNIVALS, CIRCUSES, TENT SHOWS, ETC.", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS, BY CHANGING THE PERMIT FEE FOR OPERATION OF CARNI- VALS, CIRCUSES AND TENT SHOWS; PROVIDING THAT THIS ORDI- NANCE SHALL BE CUMULATIVE OF ALL OTHER ORDINANCES AND CODE PROVISIONS; PROVIDING FOR THE REPEAL OF ALL ORDINANCES AND CODE PROVISIONS IN CONFLICT HEREWITH; PROVIDING A SEVERA- BILITY CLAUSE; PROVIDING A PENALTY: AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: dart i nn 1 _ That Chapter 11 of the Code of the City of Fort Worth, Texas (1964), as amended, is hereby further amended, by amending Section 11-1, thereof, and hereafter Section 11-1 shall read and be as follows: "Sec. 11-1. Permit--Required; fee; term "It shall be unlawful for any person or business to set up or operate any carnival, circus or tent show within the city unless and until such person or business has first obtained a permit and paid to the assessor-collector of taxes a permit fee in the amount of thirty dollars ($30.00). Any permit issued by the city for the setting up or operating of any carnival, circus or tent show shall expire ninety (90) days after the date of its issuance." That, should any portion, section or part of a section of this Ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judg- ment shall in no way impair the remaining portions, sections or parts of sections of this Ordinance, which said remaining provisions shall be and remain in full force and effect. Ccrtinn ~_ That this Ordinance shall be cumulative of all other ordinances and of the Code of the City of Fort Worth, except in those instances where the provisions of this Ordinance are in direct conflict with such other ordinances and such Code, in which instances said con- flicting provisions are hereby expressly repealed. .. Section 4. That any person, firm or corporation who violates, disobeys, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. Section 5. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and penalty clause and effective date of this ordinance for five (5) days in the official newspaper of the City of Fort Worth, Texas, a s authorized by TEX.
