AN ORDINANCE AMENDING CHAPTER 22, "JUNK," OF THE CODE OF THE CITY OF FORT WORTH, TEXAS, BY CHANGING THE LICENSING FEE FOR MOTOR VEHICLE JUNK YARDS AND BUSINESSES; PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL PRIOR ORDINANCES AND CODE PROVISIONS; REPEALING ALL ORDINANCES AND CODE PROVISIONS IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS SECTION 1. That Chapter 22, "Junk," of the Code of the City of Fort Worth (1964), as amended, is hereby further amended at Section 22-21, and that hereafter, said Section shall be and read as follows: "Sec 22-21 License. "The Building Official shall issue a license to oper- ate a motor vehicle junk yard or business upon presenta- tion of a certificate of occupany and written approvals by the Health, Fire, Police and Public Works Departments, following tYi~.e inspections required in Section 22-20 Such license shall be issued in the name of the applicant and shall not be transferable. The fee for such license shall be Five Hundred Dollars ($500.00) per annum and shall be renewed on. or before the anniversary date of the last issuance.'` "Said license may be revoked by the Building Official upon the rendition of a final judgment in any court of competent jurisdiction against the licensee for the unlaw- ful operation of said yard or business. No such license shall be reissued prior to the passage of six (6) months following said rendition." ~ ~~ SECTION 2. i i ~ ~~ Y That, should any portion, section or part of ,'a section of this ~~ ti fit, Ordinance be declared invalid, inoperative or void for^any reason by a court of competent jurisidiction, such decision, opinion or judg- ment shall in no way impair the remaining portions, sections or parts of sections of this~Ordinance, which said remaining provisions shall be and remain in full force and effect. J' SECTION 3. V That this Ordinance shall be cumulative of all other ordinances and of the Code of the City of Fort Worth, except in those instances s,, _ f , . ~ ^' ~ ,~: where the provisions of this Ordinance are in direct conflict with such other ordinances and such Code, in which instances said con- flicting provisions are hereby expressly repealed. SECTION 4. That any person, firm or corporation who violates, disobeys, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5. That the City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and penalty clause and effec- tive date of this Ordinance for five (5) days in the official news- paper of the City of Fort Worth, Texas, as authorized by the TEX. REV. CIV. STATS., Art. 1176b-1. SECTION 6. That this Ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained.
