ORDINANCE NO d !J AN ORDINANCE AMENDING CHAPTER 19, "HEALTH AND SANITATION," OF THE CODE OF THE CITY OF FORT WORTH (1964), AS AMENDED, BY INCREASING THE PUBLIC HEALTH SERVICE FEES AT THE SEXU- ALLY TRANSMITTED DISEASE CLINIC, THE IMMUNIZATION CLINIC; AUTHORIZING PUBLICATION IN PAMPHLET FORM; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 19-440.1 of Chapter 19 of the Code of the City of Fort Worth (1964), as amended, be, and the same is hereby amended so that hereafter same shall read and be as follows: "Sec. 19-440.1. Public Health Service Fees. "The Department of Public Health shall be entitled to collect the following fees from those individuals using the facilities and/or services of the department as listed below: (a) Public Health Laboratory (1) bacteriological analysis of standard water sample ................ ............ $ 5.00 '`-~ (2) chemical analysis of standard water sample........ ....................... $50.00 Regulatory or complaint water samples that are sub- mitted to the laboratory from the Environmental Health Division of the City of Fort Worth Health Department, the Environmental Health Division of the Tarrant County Health Department, or the State Health Department, Region V., shall be exempt from imposi- tion of these fees. (b) Sexually Transmitted Disease Clinic (1) clinic fee, includes initial and two follow-up visits ....... ................. $ 6.00 (2) laboratory fee (a) Tarrant County Hospital District facilities ..... ............... .... $ 3.00 (b) All other outside agencies. .... .... $ 5.00 (c) Immunization Clinic (1) yellow fever immunization ........ ... ... $10.00 (2) clinic fee . ............ .. .. ...... $ 2.00 (3) copy of immunization record.......... .. $ 2.00 (d) Dental Clinic - 1 clinic fee ............. .............. $ 4.00" r.~~r , ~~ .. SECTION 2. That the City Secretary of the City of Fort Worth is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and this ordinance as so published shall be admissible in evidence in all courts without further proof than the production of said pamphlet, as provided in Section 3, Chapter XXV of the Charter of the City of Fort Worth. SECTION 3. This ordinance shall repeal every prior ordinance and provi- sions of the Fort Worth City Code in conflict herewith but only insofar as any portion of such prior ordinance or provision shall be in conflict, and as to all other ordinances or provisions of the Fort Worth City Code not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such un- constitutional phrase, clause, sentence, paragraph or section. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained.
