ORDINANCE NO. 9oZ
AN ORDINANCE AMENDING CHAPTER 45, "CITIZENS' CABLE BOARD,"
TO PROVIDE FOR NINE (9) PLACES ON THE BOARD; PROVIDING FOR
STAGGERED, TWO-YEAR TERMS FOR BOARD MEMBERS; PROVIDING A
LIMIT FOR TERMS OF SERVICE ON THE BOARD; REPEALING ALL
CODE SECTIONS AND ORDINANCES IN CONFLICT HEREWITH; MAKING
THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; ENGROS-
SING AND ENROLLING THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 45-1 of Chapter 45 of the Code of the City of Fort
Worth (1964), as amended, is hereby amended and that after such
amendment, Section 45-1 shall read and be as follows:
"Sec. 45-1. Creation and appointment of Citizens
Cable Board; terms of office, etc.
"The City Council shall appoint a Citizens' Cable
Board comprised of citizens of the City of Fort Worth. The
Board shall consist of nine (9) members, who shall serve
in places numbered 1 through 9. Members appointed to odd-
numbered places shall serve terms which expire October 1,
1983. Members appointed to even-numbered places shall
serve terms which expire October 1, 1984. Thereafter, mem-
bers shall serve two-year terms. No member shall serve
more than three consecutive two-year terms, and the terms
of current members of the Board shall be counted toward
the limit of terms to be served.
"The following shall be ex officio non-voting members
of the Board: two (2) City staff members, the cable com-
pany's Community Access Director and the cable company's
General Manager.
"The Board shall adopt bylaws governing its proced-
ures and actions coming before it."
SECTION 2.
This ordinance shall repeal every prior ordinance and provi-
sions of the Fort Worth City Code in conflict herewith but only
insofar as any portion of such prior ordinance or provision shall be
in conflict, and as to all other ordinances or provisions ~of the rt

Fort Worth City Code not in direct conflict herewith, this ordinance
shall be and is hereby made cumulative.

SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,

paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation in this ordinance of
any such unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 4.
That the City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the caption
in the minutes of the City Council and by filing the ordinance in
the ordinance records of the City.
SECTION 5.
That this ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Background
On March 15, 1983, the City Council approved Ordinance No. 8758, "Rules for Boards
and Commissions." That ordinance establishes nine membership places for each Cit
board, unless membership is governed by conflicting state law, City Charter provi
sion or Council exception. It also provides for two-year, staggered terms for
board members. The Citizens' Cable Board is currently composed of thirteen members
and does not have specific membership places or staggered two-year terms. Th
attached ordinance will incorporate the above provisions of Ordinance No. 8758 for
the Citizens' Cable Board. The ordinance will also provide that no member shal
serve more than three consecutive terms.
Recommendation:
It is recommended that the attached ordinance be adopted, amending City Cod
Chapter 45, "Citizens' Cable Board," establishing nine membership places and two
year, staggered terms for members and limiting members' service to three consecu
tive terms.
