HomeMy WebLinkAboutOrdinance 8725a ~~ Y / • d ~i ORDINANCE NO. ~~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING THE SIXTEEN FOOT WIDE EA5T-WEST ALLEY LOCATED IN BLOCK 1, CHAMBERLIN ARLINGTON HEIGHTS ADDITION, FIRST FILING; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the sixteen foot (16') wide east-west alley located in Block 1, Chamberlin Arlington Heights Addition, First Filing, from Hulen Street east to its intersection with the twenty foot (20') wide north-south alley adjacent to said block, be and the same is vacated, abandoned, and permanently closed as an alley right-of-way. SECTION 2. That the fee to the lands in the above described vacated alley right-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are re- tained for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. DATE REFERENCE SUBJECT Vacation of Alley: Chamberlin PAGE NUMBER Arlington Heights Addition, First Filin , 1 2/1/83 ,,;* PZ-1162 Block 1, Lots 15-26 (Revised) > or-..---- - Crestline Road & Hulen Street (V-$2-48) 3 Mr. Gar3k Santerre, Director of Transportation/Public Works Department, City of-Fort Worth, with the written consent of all abutting property owners, has requested that the City vacate the 16' wide east-west alley in Block 1, Chamberlin Arlington Heights Addition, First Filing, from Hulen Street east -to a-2:0, wide north-south alley, as shown on the attached map. The subject alley right-of-way, acquired by dedication, is partially open on the ground (western half), unimproved, and contains electric, gas and telephone utility facilities The subject vacation request is made in order to replat the vacated right-of-way with abutting property, to expand the building area, and provide more usable yard space. Reviewing City departments and private utility companies have raised no objections to this request, provided the vacated right-of-way is replatted with adjacent property and the vacated right-of-way is retained as utility easement for existing utilities. A satisfactory replat, dedicating and retaining the necessary utility easement(s), has been submitted The City Plan Commission has reviewed this request and recommends that the subject alley be vacated as requested Recommendation It is recommended that an Ordinance be adopted vacating the 16' wide east-west alley in Block 1, Chamberlin Arlington Heights Addition, First Filing, as recommended by the City Plan Commission DAI•jc Attachment APPROVED BY c-TY cou~ucj~ FEB 1 1983 ~ .IJL1"7r/t..
