AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
AVENUE "B"
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR BEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILLING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
UNIT 1: AVENUE "B" From Ash Crescent to Poly Freeway, known and designated
as Project No. 104-24000-243, Unit 1, a six-inch thick
hot-mix asphaltic concrete pavement on a six-inch thick
lime' stabilized subgrade with seven-inch high concrete
curb and eighteen-inch wide concrete gutter on a thirty
foot roadway. Six-inch thick concrete driveways will
be constructed where specified.
UNIT 2: EAST CANTEY STREET From Bryan Avenue to Stuart Drive, known and designated
as Project No. 104-24000-243, Unit 2; a six-inch thick
hot-mix asphaltic concrete pavement on an eight-inch
thick lime stabilized subgrade with seven-inch high
concrete curb and eighteen-inch wide concrete gutter on
a thirty foot roadway. Six-inch thick concrete drive-
ways will be constructed where specified.
UNIT 3: BRYAN AVENUE From Shaw Street to Bewick Street, known and designated
as Project No. 104-24000-243, Unit 3, a six-inch thick
hot-mix asphaltic concrete pavement on a six-inch thick
lime stabilized subgrade with seven-inch high concrete
curb and eighteen-inch wide concrete gutter on a thirty
foot roadway. . Six-inch thick concrete driveways will
be constructed where specified.
UNIT 4: OLD BURLESON RO:4D From Highway 81 to Thornhill Drive, known and design-
ated as Project No. 104-24000-243, Unit 4, a six-inch
thick hot-mix asphaltic concrete pavement on an eight-
inch thick lime stabilized subgrade with seven-inch high
concrete curb and eighteen-inch wide concrete gutter on
a thirty-six foot roadway. Six-inch thick concrete
driveways will be constructed where specified.
UNIT 4-A: [NEST SERVICE ROAD OF From 220' north of Felix Street to old Burleson Road,,
NORTH-SOUTH FREE14AY known and designated as Project No. 104-24000-243,
Unit 4-A, a ten and one-half foot widening with seven-
inch reinforced concrete pavement on a four-inch thick
crushed limestone base with- seven-inch high superimpos-
ed concrete curb. Six-inch thick concrete driveways
will be constructed where specified.
UNIT 5: RYAN AVENUE From Boyce Street to Spurgeon Street, known and desig-
nated as Project No. 104-24000-243, Unit 5, a five-inch
thick hot-mix asphaltic concrete pavement on a six-inch
thick lime stabilized subgrade with seven-inch high con-
crete curb and eighteen-inch wide concrete gutter on a
thirty foot roadway. Six-inch thick concrete driveways
will be constructed where specified.

together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers/ and drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made and
entered into with R. W. Gibbins, Inc. ;
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT;
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
UNIT 1: AVENUE "B" From Ash Crescent to Poly Freeway, known and
designated as Project No. 104-24000-243, Unit 1.
The estimated cost of improvements is $ 26.130.72 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 3.56 ; the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 8.88
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ 1.54 per square foot; the total
estimated amount per front foot to be as against abutting property and the owners
thereof is $_x_44 , plus the cost incurred for concrete driveway construction
where specified.

A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or .claiming any interest in any such property. Such hearing shall be
given and held on the 21st day of April , 19_7,5_, at 9!30 A.M,,
in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and
the City Secretary is hereby directed to give or cause to be given notice ,of the
time and place of such hearing and of,-,other 'matters and facts in accordance with
the terms and provisions of an Act pased at the First Called Session.of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session,. now being known as Article 1105b of Vernons Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May- 12, 1967. Such notice shall be.by advertisement inserted
at least three (3) times in a newspaper published in the -City of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before -
the date of said hearing; Said notice shall comply with and be in accordance with
. the terms and provisions of said Act as amended. The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting ori said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United-States Mail at least fourteen (14) days before the
. date of the hearing, postage prepaid, in envelopes addressed to all persons
owning or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names bf such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do .not appear on such rendered tax rolls, then address to .such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be ,improved is listed as "unknown" on the then. current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown,' no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the-
properties to be assessed,, the names of those .,pers:ons owning or claiming any
interest in saidproperties to whom the notice was mailed,: together with the last
known addresses determined as aforesaid of the respective owners and those' per�
sons owning or claiming any interest in said property,
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or unrendered tax rolls of the City
of Fort Worth was mailed a copy .of the notice of hearing and shall further certify
the date or dates . on which said notice was mailed. A copy of each notice shall be
attached to such' certificate. The certificate of the City Secretary will be con-
clusive evidence of the facts therein recited.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and

The estimated cost of improvements is $ 10,857 99 the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 3.60 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 99-13 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $__O_ the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $1.54 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the

designated as Project No. 104-24000-243, Unit 3.
The estimated cost of improvements is $ 20.762.66the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 3.56 ; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 8.88 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- _ wide concrete sidewalk is $_-_0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $-1.54— per square foot; the total
estimated amount per front foot to be assessed against abutting property and the
owners thereof is $ 12.44 plus the cost incurred for concrete driveway con-
struction where specified.

The estimated cost of improvements is $ 81,678.55 the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb and gutter is $ 3,60 _; the estimated amount per front foot to be
assessed against abutting property and the owners thereof for pavement is $ 10.10 ;
the estimated amount per front foot to be assessed against abutting property and
the owners thereof for -0- wide concrete sidewalk is $ -0- ; the estimated
amount per square foot to be assessed against abutting property and the owners
thereof for 6-inch thick concrete driveway is $.1 54 per square foot; the total

Initiation of Project
Units 1, 2, 3 and 5 were initiated by paving petitions from adjacent property
owners. Unit 4 was initiated by Community Facilities Contract No. 6791, M&C
C-1954, dated 4/5/71, whereas Unit 4A is City initiated in order to correct
an existing paving skip. Unit 6, Hammond Street Storm Drai_r, is necessitated
by the improvement of Old Burleson Road end to correct drainage complaints
in the general area.
Improvements
All Units, with the exception of Unit 4A, will be improved with residential
grade hot-mix asphaltic concrete pavement, with concrete curb, gutter and
driveway approaches and required drainage appurtenances. Unit 4A will be
widened 10.5 feet with 7" concrete pavement, 7" superimposed concrete curb
and concrete driveway approaches to match the existing roadway and "'exas
Highway Department specifications. Hammond Street Storm Drain will consist
of 18" to 33" R.C.P. from Old Burleson Road, west to Timothy Street and south
to Spurgeon Street.

The following contractors took plans and specifications, but did not submit
a bid:

Deletion of Unit and Bid Item
Unit 2, East Cantey Street, was initiated by a paving petition in May, 1973,
in that the owner of 50% of the abutting property signed and forwarded a
paving petition to the Public Works Department. However, the owner defaulted
in his purchase contract and the property reverted to Tarrant Savings and
Loan Association on March 3, 1975. Tarrant Savings Association has request-
ed the street not be improved at this time. In addition, the two remaining
owners who did not sign the original petition, have joined in the request to
not pave the street at this time. Consequently, it is recommended that
Unit 2, East Cantey Street, be deleted from the project.
Included in the bid items for Unit 6, Hammond Street Storm Drain is the
relocation of 80 linear feet of 8 inch water main. The overall low bidder
is not qualified with the City Water Department to accomplish water and
sanitary sewer adjustments. As a result, the Water Department has recommend-
ed that the item be deleted from the contract and the adjustment be accomp-
lished by City Water Department forces.
The above two items are included in Change Order No. 1.
Project Cost and Financing
Based on the low bid and standard policy, not including Unit 2, approximately
$61,837.26 is proposed to be assessed against abutting property owners, which
will be provided for by a bond fund transfer from the Revolving Fund
Unspecified. The cost to the City for construction, inspection engineering,
administration and miscellaneous expenses is estimated to be approximately
$187,077.13 which $108,320.30 is for the Hammond Street Storm Drain. A
bond fund transfer of $179,000 from the Assessment Paving Unspecified Account
is required to supplement the approximately $8,500 in the Project Account
No. 104-24000-243.

On Monday, March 10, 1975, a Neighborhood Meeting was held by the Engineering,
Division of the Public Works Department at the Worth Heights Elementary School,
for the Assessment Paving at 5 Locations oa the South Side, Project No, 104-
24000-243,
Odell Schmidt explained the procedures concerning the proposed improvements.,
owner participation in cost and methods of payment to the twenty-seven property
owners that were present,
After this explanation the meeting was opened for discussion,
Unit 1, Avenue "B",� No objections.
Unit 2, Cantey Street.- Mre W� E, Plumb of the Tarrant Savings Association,
representing Lots 12 and 13, Block 3, stated that he felt the present paving
was adequate for the area served and that the proposed improvements were un-
necessary, Mr. Ravos Ford, owner of Lot 24, Block 10, also objected to the
improvements. Mr. Robert Shaw, owner of Lot 1, Block 10, said that Cantey
Street was adequate to serve his business and that he objected to further
improvements
Unit 3, Bryan Avenue, No objections,
Unit 4, Old Burleson Road,, Mr. Cecil Fries, owner of Lot 10, Block 1, said
he objected to the improvements, He said that he felt the street would be
of no benefit to his property, Mrs, Fries said that she had been authorized
to speak for four other property owners who were unable to attend the meet-
ingr Mrs, Fries said that: all four objected to the improvements. Mr® Louis
Dressier, owner of Lot 6, Block 2, said that if the street was improved that
it would be nothing but a speedway,, He said that he objected to the noise
and litter that would be created by improving this street® Several other
property owners stated that since they had no access to this street they
should not be assessed,
Unit 4--A9 Service Roads Both property owners requested wider driveways,
Unit 5, Ryan Avenue,,, No objections.
After a short general discussion, the meeting was adjourned,

In accordance with the proceedings of your Honorable Body, I have prepared estimates
of the cost of street improvements as shown below.-
Estimates of the total cost of improvements on a portion of Avenue "B" and portions
of sundry other streets, avenues and public places in the City of Fort Worth Worth,
Texas, and estimated amounts per front foot to be assessed against abutting property
and the owners thereof, on each portion of street, avenue and public place are as
follows, to-wit:
