ORDINANCE NO. ~ ~oc
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND
EXTINGUISHING A 12 FOOT WIDE EAST/WEST UTILITY EASEMENT,
THE CENTERLINE OF WHICH LIES ALONG THE COMMON LOT LINE OF
LOTS 69R AND 75R, DISSEL TRACT, FROM THE NORTHEAST CORNER
OF LOT 75R WESTWARD 200 FEET TO NINTH AVENUE; VACATING,
ABANDONING, CLOSING, AND EXTINGUISHING A 12 FOOT WIDE
EAST/WEST UTILITY EASEMENT, THE CENTERLINE OF WHICH LIES
ALONG THE COMMON LOT LINES OF LOTS 69R, 79R, AND 80R,
DISSEL TRACT, FROM A POINT 7.5 FEET EAST OF THE NORTHWEST
CORNER OF LOT 79R WESTWARD 102.5 FEET TO THE WEST
RIGHT-OF-WAY LINE OF AN 18 FOOT WIDE NORTH/SOUTH ALLEY,
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE .CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE following be and the same are vacated, abandoned, .and
permanently closed and extinguished as utility easements:
A. The 12 foot wide east/west utility easement, the
centerline of which lies along the common lot line of
Lots 69R and 75R, Dissel Tract, from the northeast
corner of Lot 75R westward 200 feet to Ninth Avenue;
and
B. The 12 foot wide east/west utility easement, the
centerline of which lies along the common lot line of
Lots 69R, 79R, and 80R, Dissel Tract, said easement
being more particularly described by metes and bounds
in Exhibit "A", attached hereto and incorporated
herein.
SECTION 2.
That the fee to the land in the above described vacated utility
easements is hereby released and shall revert to the adjacent owner
as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

Commerce Mortgage, Owner of all abutting property, has requested that the City

of Lots 69R and 75R, Dissel Tract, extending from the northeast corner of
Lot 75R westward 200' to Nfnth Avenue; and,

of Lots 69R, 79R and 80R, Dissel Tract, extending from a point 7.5' east
of the northwest corner of Lot 79R westward 102 5' to the west right-of-
way lirie of an 18' north/south alley, all as shown on the attached map.
The subject utility easements, acquired by dedication, are platted, but
contain no utility facilities. The subject vacation request is made in order
to expand the building area and provide more usable yard space.
Revieweing City departments and private utility companies have raised no
objections- to this request.
Recommendation
~t is recommended that an ordinance be adopted vacating the two, 12' wide,
east/west utility easements collinear with the common lot lines of and con-
tained within. Lots 69R, 75R, 79R and 80R, Dissel Tract Addition.
