WHEREAS, the City of Fort Worth (City) and Wade & Associates,
Inc. , (Engineer) made and entered into City Secretary Contract No.
23763, (the Contract) which was authorized by the City Council by
MSC C-16691 on the 24th day of March, 1998; and subsequently
revised by two previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Main M-390 Drainage
Area, Sanitary Sewer Rehabilitation and Improvements (Group 6,
Contract 1) , Part 5 and M-106R Drainage Area Sanitary Sewer
System Rehabilitation and Improvements (Group 4, Contract 2) ,
Part 7.
WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated August 1,
2000 a copy of which is attached hereto and incorporated herein.
The cost to City for the additional design services to be performed
by Engineer total $7, 864.44.

Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $335,883 . 68

All other provisions of. the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Domenech:
We are submitting Amendment No. 3 to the above referenced contract to account for additional work
beyond the original scope of work that includes the re-bidding of Units 2, and 3, and the removal of
Unit 5 due to the rejection of all bids awarded to Nadezda. The costs associated with the re-printing of
the bid documents, the development of mylar originals and the production of State Revolving Fund
documents are discussed collectively for all project units and included in the subcontractor services
item shown below. Specifically, we are seeking approval of the following additional work items in
the amendment request as described below:

• The rebid of Units 2,3 & 5 due to the rejection of bids by the City.
The City of Fort Worth rejected all bids awarded to Nadezda, which required the re-bid of Units 2
& 3 of the M-390 design project. Since the original project was advertised in two advertised
contracts as Unit 2 and then Units 1, 3 &5, and Unit 1 bids were accepted by the City, WADE had
to make various modifications to the existing project plan sheets and contract documents to reflect
the re-bid status for Unit 2, and Unit 3, plus address the removal of the Unit 5 information from the
project. Unit 5, designed by Dikita, was removed by Wade staff from the new contract documents
and forwarded to the City for re-advertising under another project. This effort involved
substantive coordination with Dikita staff since the engineer of record is no longer with the
company. The table below reflects the staff hours and miscellaneous costs associated with this
work item:

Therefore, we are requesting Contract Amendment No. 3 in the amount of $ 7,864.44 to the M-390
Agreement. This amendment would increase the total contract amount from $328,019.24 to
$335,883.68, representing an increase of 2.4 percent (2.40%). WADE was directed to re-advertise
these projects and received verbal authorization prior to performing the services discussed above.
Please be advise that we will in the near future be submitting the final contract amendment for M-390
which will seek to recover substantive survey costs exceeding the budgeted amounts for this contract.
At this time we estimate to seek about$13,950.00 plus administrative costs.

The proposed amendment will reimburse Wade & Associates, Inc. (WAI), for the addi-
tional services they provided on the project as requested by the City.
Due to the City's rejection of the originally advertised three (3) units, WAI was directed
by city staff to revise the original project plans and contract documents in preparation for
re-advertisement. The re-bid required substantial modifications and reprinting of the
original submittals which necessitated the expenditure of additional time and effort, on
the part of the consultant, in order to comply with the request.
Wade & Associates, Inc., has requested reimbursement in the amount of $7,864.44 for
the additional services thereby increasing the contract fee from $328,019.24 to
$335,883.68. 1 believe this fee is fair and reasonable for the additional services that were
provided.
Please authorize this additional design fee by your signatures on the attached contract
amendment form.
