INTERLOCAL AGREEMENT

This Agreement is made and entered into this day of
2000, by and between the County of Tarrant, acting herein by and throu its
governing body, the Commissioners Court, hereinafter referred to as COUNTY,
and the City of Fort Worth, hereinafter referred to as City, both of Tarrant County,
State of Texas, witnesseth:
WHEREAS, this Agreement is made under the authority of Sections
791.001 — 791.029, Texas Government Code; and
WHEREAS, each governing body, in performing governmental functions
or in paying for the performance of governmental functions hereunder, shall
make that performance or those payments from current revenues legally
available to that party; and
WHEREAS, each governing body finds that the performance of this
Agreement is in the common interest of both parties, that the undertaking will
benefit the public and that the division of costs fairly compensates the performing
party for the services or functions under this agreement; and
WHEREAS, the intersections of Dirks Road and Bryant Irvin Road and
Dirks Road and Harris Parkway are T-intersections within the shared jurisdiction
of COUNTY and CITY; and
WHEREAS, each governing body agrees to share in the cost of the
services described below.
NOW THEREFORE, the COUNTY and the CITY agree as follows:
1.
COUNTY agrees to contribute a total sum of $100,000 for installation of
two (2) traffic signal devices for the following intersections:
Dirks Road and Bryant Irvin Road - $50,000
Dirks Road and Harris Parkway - $50,000

CITY specifically agrees that COUNTY shall have no additional obligation
regarding these devices including by way of example and without limitation,
maintenance, utilities, or any other operational expenses regarding these devices
and their associated equipment. COUNTY shall make one half of its payment on
billing from CITY providing that the equipment for the traffic signal devices has
become property of the CITY and COUNTY shall pay the remainder within thirty
days after the completion of the project by the CITY.

CITY agrees to purchase, install, own, operate and maintain the traffic
signal devices in accordance with state law and to contribute a total sum of
$100,000 for installation of two (2) traffic signal devices for the following
intersections:
Dirks Road and Bryant Irvin Road - $50,000
Dirks Road and Harris Parkway - $50,000
3.
Nothing in the performance of this Agreement shall impose any liability for
claims against COUNTY other than claims for which liability may be imposed by
the Texas Tort Claims Act.
4.
Nothing in the performance of this Agreement shall impose any liability for
claims against CITY other than claims for which liability may be imposed by the
Texas Tort Claims Act.
5.
The parties to this Agreement do not intend for any third party to obtain a
right by virtue of this Agreement.
6.
By entering into this Agreement, the parties do not intend to create any
obligations express or implied other than those set out herein; further, this
Agreement shall not create any rights in any party not a signatory hereto.

SUBJECT AUTHORIZATION OF INTERLOCAL AGREEMENT AND APPROVAL OF
APPROPRIATION ORDINANCE WITH TARRANT COUNTY FOR INSTALLATION OF
TWO TRAFFIC SIGNAL DEVICES ON DIRKS ROAD
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to enter into an Interlocal Agreement with Tarrant County for the
installation of two traffic signal systems on Dirks Road; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Street Improvements Fund up to $100,000 from increased revenues upon receipt of funds from
Tarrant County.
DISCUSSION:
This agreement will allow Tarrant County to participate by providing one-half (1/2) of the construction
funding for the installation of two new traffic signal systems, one each at the intersections of Dirks
Road and Bryant Irvin Road, and Dirks Road and Harris Parkway. The estimated funding provided by
the County will be $100,000. The total estimated construction cost is $200,000.
A traffic signal warrant study concluded that these intersections meet the warrant requirements for
traffic signals based on the Manual on Uniform Traffic Control Devices. The Transportation and Public
Works Department proposes to install fully actuated traffic signals.
Both intersections are located in COUNCIL DISTRICT 3.
FISCAL INFORMATION/CERTIFICATION:
The Transportation and Public Works Department will be responsible for the collection-and deposit of
funds from Tarrant County under this agreement.
