(~ AN ORDINANCE FINDING AND DECLARING UNSUITABLE AND INADE- QUATE FOR USE AS PUBLIC PARKS THE PROPERTIES SITUATED IN THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, IDENTIFIED AS: (A) A PARCEL OF LAND APPROXIMATELY 200 FEET BY 200 FEET, EXCLUSIVE OF ADJOINING STREETS PRESENTLY KNOWN AS ELDER AVENUE, ISHAM, NOTTINGHAM AND MILAM STREETS, AND FORMERLY KNOWN AS EDER AVENUE, FIRST STREET, MAIN STREET AND HATTIE STREET, AS REFLECTED IN VOLUME 388, PAGE 38, PLAT RECORDS, TARRANT COUNTY, TEXAS, SAID PARCEL ALSO KNOWN AS THE PUBLIC SQUARE OF THE COMMUNITY OF EDERVILLE; AND (B) A PARCEL OF SOME .32 ACRES OF LAND LOCATED OUTSIDE OF THE LEVEE WEST OF TRINITY PARK AND 300 FEET EAST OF FOCH STREET AND 400 FEET SOUTH OF WEST LANCASTER AVENUE BUT NOT SITUATED ADJACENT TO A PUBLIC STREET; AND PROVID- ING FOR THE SUBMISSION OF PROPOSITIONS CONCERNING THE SALE OF SAID TWO (2) PARCELS OF LAND TO THE QUALIFIED VOTERS OF THE CITY OF FORT WORTH, TEXAS, AT AN ELECTION HEREBY CALLED AND ORDERED FOR TUESDAY, THE 8TH DAY OF NOVEMBER, A.D. 1983. WHEREAS, the City of Fort Worth heretofore acquired the follow- ing tracts of land situated within the City of Fort Worth, Tarrant County, Texas, for public use: (A) A parcel of land approximately 200 feet by 200 feet, exclusive of adjoining streets presently known as Elder Avenue, Isham, Nottingham and Milam Streets, and formerly known as Eder Avenue, First Street, Main Street and Hattie Street, as reflected in Volume 388, Page 38, Plat Records, Tarrant County, Texas, said parcel also known as the Public Square of the Community of Ederville; and (B) A parcel of some .32 acres of land located outside of the levee west of Trinity Park and 300 feet east of Foch Street and 400 feet south of West Lancaster Avenue but not situated adjacent to a public street; and WHEREAS, the above described property has become unsuitable and inadequate for use as a part of the public parks of the City of Fort Worth; and WHEREAS, the City of Fort Worth has no present nor foreseeable public use for the above described property and deems it to be in the public interest to abandon any public use thereof and, subject to the concurrence of the electorate, dispose of the same through public sale, all in accordance with the laws and ordinances of this City and State; NOW, THEREFORE, r S .. ~; x BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described parcels of public property hereto- fore devoted to park purposes are found and declared unsuitable and inadequate for use as public parks: (A) A parcel of land approximately 200 feet by 200 feet, exclusive of adjoining streets presently known as Elder Avenue, Isham, Nottingham and Milam Streets, and formerly known as Eder Avenue, First Street, Main Street and Hattie Street, as reflected in Volume 388, Page 38, Plat Records, Tarrant County, Texas, said parcel also known as the Public Square of the Community of Ederville; and (B) A parcel of some .32 acres of land located outside of the levee west of Trinity Park and 300 feet east of Foch Street and 400 feet south of West Lancaster Avenue but not situated adjacent to a public street. CRC'TT(lN 7 _ That in compliance with the laws and Constitution of the State of Texas, the following propositions shall be submitted to the qual- ified voters of the City of Fort Worth, Texas, at an election here- by called and ordered for Tuesday, the 8th day of November, A.D. 1983: PROPOSITION 1 Shall the City of Fort Worth through its City Council be authorized to sell a parcel of land approximately 200 feet by 200 feet, exclusive of adjoining streets, as reflected in Volume 388, Page 38, Plat Records, Tarrant County, Texas, and identified as the Public Square of the Community of Ederville? PROPOSITION 2 Shall the City of Fort Worth through its City Council be authorized to sell approximately .32 acres of land located outside of the levee west of Trinity Park and 300 feet east of Foch Street and 400 feet south of West Lancaster Avenue? That the City Secretary of said City shall prepare ballots to be used in voting machines in said election, on which ballots shall be printed in English and in Spanish the propositions hereinabove set forth. -2- ~.. ;. 5` - _ ~' ['+T l~TT/'1 TT A That all voters who favor one or more of the propositions to sell the properties hereinabove described shall vote "FOR the sale" with respect to the proposition(s) they favor and those voters opposed to one or more of the propositions to sell the properties hereinabove described shall vote "AGAINST the sale" with respect to the proposition(s) they oppose. SECTION 5. That absentee voting shall be conducted by two methods: (1) Voting by personal appearance at the Fort Worth City Hall, 1000 Throckmorton Street, Fort Worth, Texas 76102, and (2) Voting by mail. Absentee voting shall be on paper ballots and each absentee voter shall indicate his vote "FOR the Sale" or "AGAINST the Sale" with respect to each proposition to sell the properties hereinabove described, by placing an "X" in the square beside the alternative for which he wishes to vote with respect to each proposition; pro- vided, however, that if the voter places a plus sign (+) or a check mark (~/), or any other mark which clearly shows his intention in such place, it shall be counted "FOR" or "AGAINST" the sale, as indicated. That the failure of a voter to mark his ballot in strict conformity with the directions or failure to vote on all proposi- tions shall not invalidate the ballot, and the ballot shall be counted on all propositions wherein the intention of the voter is clearly ascertainable, except where the law expressly prohibits the counting of the ballot. It is specifically provided that the election officers shall not refuse to count any Absentee Ballot because of the voter having marked his ballot by scratching out the alternative with respect to each proposition for which he does not -3- wish to vote; and that in this connection the attention of the Absentee Ballot Canvassing Board is directed to the provisions of Article 6.06 of the Election Code of the State of Texas. ,..,„mT~,., That voting machines approved by the Commissioners' Court of Tarrant County, Texas, shall be used at the election on November 8, 1983, in strict compliance with the applicable provisions of Article 7.14 of the Election Code of the State of Texas, as amended, and other applicable provisions of such Election Code. ~n~mT~~~ That the polls shall be kept open from seven o'clock A.M. until seven o'clock P.M. on November 8, 1983, and that due returns shall be made to the City Council showing the number of votes cast for and the number of votes cast against each proposition, respectively. SECTION 8. That the City Secretary of the City of Fort Worth shall furnish election officials said ballots and voting machines, together with any other forms, blanks or instructions in accordance with the Charter of the City of Fort Worth and the laws of the State of Texas, insofar as same are applicable. c~+nmTnnT l 1 That this ordinance shall constitute the proclamation, call, notice and ordinance calling and ordering said election; that same shall be published at least one time, in English and in Spanish, not more than 25 days nor less than 10 days before the election, in at least one daily newspaper published in the City of Fort Worth; or in lieu of said publication, the City Secretary is hereby directed to post or cause to be posted said proclamation, call, notice and ordi- nance in each voting precinct, or at the polling place of combined voting precincts, at least twenty (20) days before said election. -10- SECTION 12. That the way and manner of holding this election, the notice to be given therefor, the polling places, the personnel and the offi- cers who are to hold same, and all details connected with the holding of the election shall be provided for and arranged by the City Secretary; that the proper notice and publication of this notice, proclamation and ordinance shall only be cumulative of and in addition to the statutory notice of said election as herein pro- vided; and that any omission or irregularity in the publication of this notice, proclamation and ordinance, or in the signing of same, shall not in any way affect or invalidate such election. SECTION 13.
