WHEREAS, the City of Fort Worth (City) and Wade 6 Associates,
(Engineer) made and entered into City Secretary Contract No. 22266,
(the Contract) which was authorized by the City Council by MSC
15708 on the 15th day of October 1996; and subsequently revised by
two previous amendments; and
WHEREAS, the Contract involves engineering services for the
following project:
Engineering contract for the design of Sanitary Sewer Main
C1C4B Drainage Area Sanitary Sewer Evaluation Study and
Improvements (Group 6, Contract 2) .
WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:

Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated September
6, 2000, a copy of which is attached hereto and incorporated
herein. The cost to City for the additional design services to be
performed by Engineer total $9,218.84 .
2 .
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work and
services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $1 ,218,074.00.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Dear Mr. Boyer:
Based on the City Staff's review comments, we are pleased to resubmit this contract
amendment for your immediate consideration and approval. This amendment reflects
a reduction in fee for services rendered on the preparation of project exhibits as
outlined in the June 8`h amendment letter. Please see the new table in the information
below:

In addition, we have incorporated several other new amendment items into this
amendment request. More specifically, we are seeking this amendment for the

specifications for the Texas Water Development Board (TWDB) regarding state
revolving funds used for the M-C1C4B, Part 5, Part 8 Units 1 & 2, Part 11 Units 1, 2,
& 3, and Part 12 Unit 1 & 2 projects. Also included is the recovery of Part 12, Unit 3
printing costs and the design change for M-44 in the Part 11, Unit 2 project, resulting
in the issuance of a new plan sheet and easement instrument. The following tables
reflect the amendment items outlined above:

Finally, we are seeking to recover $164.00 in labor and direct costs associated with
the incorporation of new M/WBE forms into the contract documents immediately
prior to advertising Ni-C1C4B Part 12, Unit 3. The project documents were complete
and ready to print when we learned that the City had modified its M/WBE forms. We
incorporated the changes and advertised the project.

In summary, WADE is seeking to only recover actual expenses that have been
incurred for this project. Therefore, we are requesting REVISED Contract
Amendment No. 3 for the M-C1C413 Agreement in the amount of $ 9,218.84. This
amendment would increase the total contract amount from $1,208,855.56 to
$1,218,074.40. Please advise us immediately if there is a problem with this request.
