ORDINANCE NO. ~ ~ 3
AN ORDINANCE AMENDING CERTAIN FIRE DEPARTMENT POSITION
PROVISIONS OF ORDINANCE NO. 8692 BY INCREASING THE NUMBER
OF CAPTAINS THEREIN PROVIDED FROM SIXTY-SEVEN TO SIXTY-
NINE., INCREASING THE NUMBER OF LIEUTENANTS FROM NINETY TO
NINETY-ONE AND BY DECREASING THE NUMBER OF FIRE FIGHTERS
FROM THREE HUNDRED TWELVE TO THREE HUNDRED NINE, SUCH
CHANGES NOT AFFECTING THE APPROPRIATIONS OF SAID ORDI-
NANCE; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDI-
NANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH: AND PROVIDING AND EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the positions provided for the Fire Department for fiscal
year 1982-1983 in Ordinance No. 8692 and in the Budget of the City
Manager be amended to provide for sixty-nine (69) rather than sixty-
seven (67) Captains, ninety-one (91) rather than ninety (90) Lieu-
tenants, and three hundred nine (309) rather than three hundred
twelve (312) Fire Fighters, without, however, change in the overall
appropriations of the Fire Department contained in said Ordinance
and Budget
SECTION 2.
That if any section, part of a section or provision of any sec-
tion of this ordinance shall be held to be void, ineffective or un-
constitutional by a court of competent jurisdiction, the holding of
such section, part of a section or provision of any section to be
void, ineffective or unconstitutional for any cause whatsoever shall
in no way affect the validity of the remaining sections and provi-
sions of the ordinance, which shall remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 8692,
and all other ordinances and appropriations amending the same except
in those instances where the provisions of this ordinance are in di-
rect conflict with such other ordinances and appropriations, in
which instances said conflicting provisions are hereby expressly
repealed.

SECTION 4.
That this ordinance shall become effective and be in full force
and effect from and after the date of its passage as provided by
law, and it is so ordained.

____On_D.e.cemb.er 28, 1982, the City Council approved Mayor and Council Communication
--G-5507, "Redeploying Fire Department Personnel," which authorized the elimi-
nation of three Fire Fighter positions, and the creation of one Fire Lieu-
tenant position and two Fire Capt n positions The M&C did not recommend
that this redeployment be accomplished by ordinance, as State Law, Art 1269m,
requires.

An ordinance has been prepared and submitted for approval. It should be noted
that the civil service status of any officers who have been promoted in the
interim will not be affected by the fact that their positions were not
originally created by ordinance, but are now being so created
Recommendation
It is recommended that the attached ordinance be adopted by the City Council,
creating one Fire Lieutenant position, creating two Fire Captain positions,
and eliminating three Fire Fighter positions
