HomeMy WebLinkAboutOrdinance 18050-04-2008Ordinance No. 18050-04-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CAPITAL PROJECTS FUND IN THE AMOUNT OF $117,013 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING CHANGE ORDER NO. 3 TO THE CONTRACT AMENDMENT NO. 2 TO THE CONSTRUCTION PHASE III OF THE CITY'S ENERGY SAVINGS PERFORMANCE CONTRACT (ESPC) WITH JOHNSON CONTROLS, INC.; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 20D7- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Capital Projects Fund in the amount of $117,013 from available funds for the purpose of executing Change Order No. 3 to the Contract Amendment No. 2 to the Construction Phase III of the City's Energy Savings Performance Contract (ESPC) with Johnson Controls, Inc. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of funds from the Public Events Fund to the Specially Funded Capital Projects Fund in the amount of $117,013; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Capital Projects Fund in the amount of $117,013 from available funds; and 3. Authorize the City Manager to execute Change Order No. 3 to City Secretary Contract No. 34222 with Johnson Controls, Inc. in the amount of $117,013, thereby increasing the total contract to $5,319,330. DISCUSSION: On September 2, 2003 (M&C C-19739), City Council authorized execution of the City's first Energy Savings Performance Contract (ESPC) with Johnson Controls, Inc. (JCI) including lighting, air-conditioning, and plumbing improvements to City Hall, Public Safety, Monroe Street Annex, and Meacham AP Terminal facilities. Completed in September 2004 at a cost of $3,063,090, ESPC Phase I has realized cost avoidance of nearly $1.2M through the first quarter of FY2007-08 exceeding the JCI-guaranteed cost avoidance of approximately $1.1 M over the same period. The ESPC allows the City to develop and implement further such projects with JCI via contract amendment. On February 7, 2003 (M&C C-21289) and September 26, 2006 (M&C C-21737), City Council authorized the execution of ESPC Phases II & III respectively with JCI by contract amendment. These phases include lighting, air-conditioning, plumbing, and electrical system improvements to the City's Will Rogers Memorial Center, Fort Worth Convention Center, and Central Library facilities. Due far completion in May 2008 at a cost of $7,574,596, these two phases have a JCl-guaranteed cost avoidance of over $1.OM annually. On September 26, 2006, (M&C C-21737) the City Council authorized the City Manager to execute Amendment No. 2 to City Secretary Contract (CSC) No. 29110 (M&C C-19739, approved September 2, 2003) with JCI in the amount of $5,178,937 for the construction of the ESPC Phase III project. (CSC No. 34222). During the construction of the ESPC Phase III, a portion of the existing heating, ventilation, air conditioning equipment and piping at the Fort Worth Convention Center was discovered to have deteriorated with age and use. Change Order No. 3 will replace the coils and some of the piping in the affected air handlers. Logname: 20ESPCIIIJCIC03 Page 1 of 2 Change Order No. 1 ($18,937) was to replace the chill water pump at the Will Rogers Memorial Center and Change Order No. 2 ($4,443) was to design a mechanical revision at the Central Library. Change Orders No. 1 and No. 2 were administratively executed. JCI, Inc., is in compliance with the City's M/WBE Ordinance by committing to 11 percent additional M/WBE participation for this Change Order No. 3.. The City's goal for this Change Order is 11 percent. The City facilities involved in this project are in COUNCIL DISTRICTS 7 and 9, but will serve Fort Worth residents in all Council Districts. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that, upon approval of the above recommendations .and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Specially Funded Capital Projects Fund.
