ORDINANCE NO . ~ ~ 3
AN ORDINANCE VACATING, ABANDONING AND CLOSING THE SOUTH 20
FEET OF A CERTAIN PORTION OF A 40-FOOT WIDE UNNAT'IED STREET
RIGHT-OF-WAY LOCATED ADJACENT TO TRACT 3, BAILEY GARDENS
ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN~CONFLICT HEREWITH AND PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the south 20 feet of a certain portion of a 40-foot wide
unnamed street right-of-way located adjacent to Tract 3, Bailey
Gardens Addition, being more particularly described by metes and
bounds as follows:
Beginning at the northeasterly corner of Tract 3, Bailey
Gardens Addition, being that portion of the said Tract 3
located north of Jacksboro Highway, said point being also
in the common lot line of Tract 2, with Tract 3, both
being in Bailey Gardens Addition;
THENCE north 12° 17' east a distance of 20 ft. to a point
for corner, said point also being in the centerline of a
40 ft. wide un-named street;
THENCE north 80° 35' west a distance of 60.6 ft., along a
line contiguous with the centerline of a 40 ft. wide un-
named street to a point for corner;
THENCE south 9° 25' west a distance of 20 ft. along a line
contiguous with the extension of the common lot line of
Lots 3 & 4, Black 135, North Fort Worth Addition, to a
point in the south right-of-way line of a 40 ft. wide un-
named street;
THENCE south 80° 35'~east a distance of 59.6 ft. along the
south right-of-way line of said 40 ft. wide un-named
street, being also the north property line of Tract 3,
Bailey Gardens Addition, to the point of beginning.
be and the same is vacated, abandoned and permanently closed as a
right-of-way for street purposes.
SECTION 2.
That the fee to the land in the above described vacated street
right-of-way is hereby released and shall revert to the adjacent
owner as provided by law, SAVE AND EXCEPT that easements are re-
tained for any and all existing and prospective utilities.

SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

the City vacate the south 20' of a 40' wide un-named street located adjacent
IS?,7;'~r~'~ct 3, Bailey Gardens Addition, extending westward a distance of 59 6'
from the east line of Tract 3, to a point directly south and contiguous with
7R~i~N'~xtension of the east lot line of Lot 3, Block 135, North Fort Worth Addition,
as shown on the attached map
The subject street right-of-way, acquired by dedication, is not open on the
ground, does not contain any known utility facilities, but does contain a use
encroachment from the abutting property to the south The purpose of this
vacation request is to permit rehabilitation of the existing building located
on Tract 3, abutting the subject right-of-way and further improvement of the
entire property to allow for off-street parking and setback requirements
Reviewing City departments and private utility companies have offered no
objections to this request
The City Plan Commission, after reviewing this request a second time on
December 29, 1982, amended their previous action to provide that this
request be recommended to the City Council, subject to the following
1) The vacated street right-of-way will be replatted with abutting property,
as each property owner submits a replat for his/her property, or as redevelop-
ment of such abutting property occurs, and, 2) The vacated right-of-way be
retained as a utility easement A satisfactory replat has been received in
comp]_iance with the above requirements
Recommendation
It is recommended that an ordinance be adopted vacating the south 20' portion
of a 40' wide un-named street abutting Tract 3, Bailey Gardens Addition,
extending 59 6' from the east line of Tract 3, Bailey Gardens Addition, to
a point directly south of the west line of Tract 3, Block 135, North Fort
Worth Addition, as such line is extended southward
