HomeMy WebLinkAboutOrdinance 8835.-_ ~: ,.~ .~, ~ ,, °'-• `KO ORDINANCE NO. ~B~S r ,, AN ORDINANCE APPROPRIATING THE ADDITIONAL SUM OF $710,000 FROM THE WATER AND SEWER FUND UNAPPROPRIATED EARNINGS; TRANSFERRING $400,000 OF THAT AMOUNT TO ACCOUNT NO. 051- 024027-00, "WATER RELOCATION AT THE INTERSECTION OF IH-30 AND IH-820"; TRANSFERRING $310,000 OF THAT AMOUNT TO ACCOUNT NO. 052-023138-00, "SEWER RELOCATION AT THE INTER- SECTION OF IH-30 AND IH-820"; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDI- NANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That there is hereby appropriated from the Water and Sewer Fund Unappropriated Retained Earnings the sum of $710,000, $400,000 of which is transferred to Account No. 051-024027-00, and $310,000 of which is transferred to Account No. 052-023138-00, for the relo- cation of water and sewer facilities at the intersection of Interstate IH-30 and Interstate 820. SECTION 2. That, should any portion, section or part of a section of this Ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judg- ment shall in no way impair the remaining portions, sections or parts of sections of this Ordinance, which said remaining provisions ..- shall be and remain in full force and effect. SECTION 3. That this Ordinance shall be cumulative of all other ordinances and appropriations except in those instances where the provisions of this Ordinance are in direct conflict with such other ordinances and appropriations, in which instances said conflicting provisions are hereby expressly repealed. ti :i, ~, r ~. ~ ~: ~~ SECTION 4. DESCRIPTION. On Dec-ember 21, 1982 (M&C C-6679), the City of Fort Worth and the State ..---•--- Department of Highways and Public Transportation (SDHPT) entered into an ----w--- agreement for the relocation of Water and Sanitary Sewer Lines at the `-""-~ ~_~ interchange of IH-30 and IH-820. The relocations were either to accommodate __ the SDHPT's proposed highway grades, or to relocate facilities which had to be moved to another approved crossing as requested by SDHPT. The Standard Utility Agreement and attachments executed by the City Manager were prepared and approved by the SDHPT for an in-kind adjustment of water and sanitary sewer facilities with no betterment involved. Because the facilities are in-kind adjustments, the cost are 100% reimbursable by the State. SUBMISSION OF BIDS: Amount of Bid Time for Completion Bidder Lanzo Construction Co. L. D. Equipment Co., Inc. $686,614.10 762,844.00 770,170.00 786,254.00 853,747.00 890,800.00 250 Working Days 170 Working Days 120 Working Days 220 Working Days 220 Working Days Not Specified PROJECT FINANCING: It is proposed to finance this construction project by appropriating $710,000.OU* from "Water and Sewer Fund Unappropriated Retained Earnings", and transferring $400,000.00 to Water Account No. 051-024027-00, "Water Relocation at the Intersection of IH-30 and IH-820" and $310,000.00 to Sewer Account No. 052-023138-00, "Sewer Relocation at the Intersection of IH-30 and IH-820". Interim costs will be accumulated in these accounts and will be billed to the State for reimbursement upon completion of the project.
