ORDINANCE NO. ~r
AN ORDINANCE AMENDING CHAPTER 28, ARTICLE III, "CITY PLAN
COMMISSION", SECTIONS. 28-11 AND 28--12 OF THE CODE OF THE
CITY OF FORT WORTH, TO PROVIDE FOR NINE PLACES ON THE CITY
PLAN COMMISSION; PROVIDING FOR STAGGERED TERMS; PROVIDING
A LIMIT FOR TERMS OF SERVICE ON THE COMMISSION; PROVIDING
FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULA-
TIVE OF OTHER ORDINANCES; REPEALING ALL PRIOR ORDINANCES
IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND
ENROLLMENT OF THIS ORDINANCE; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION I.
That Chapter 28, Article III, "City Plan Commission", of the
Code of the City of Fort Worth (1964), as amended, is hereby amended
by changing Section 28-11 thereof to read as follows:
"Sec. 28-11. Creation and appointment.
"There is hereby created a city plan commission, to
be composed of qualified electors of the city. It is the
declared policy that the city council shall consider for
appointment to the commission only those persons who have
demonstrated their civic interest, general knowledge of
the community, independent judgment, understanding of
zoning and planning and availability to prepare for and
attend meetings, and who, by reason of diversity of their
occupations, constitute a commission which is broadly rep-
resentative of the community."
SECTION 2.
That Chapter 28, Article III, "City Plan Commission", of the
Code of the City of Fort Worth (1964),. as amended, is hereby amended
by changing Section 28-12 thereof to read and be as follows:
"Sec. 28-12. Membership; terms of office.
"The City Council shall appoint the commission, which
shall consist of nine (9) members, and who shall serve in
places numbered 1 through 9. Members appointed to odd-
numbered places shall serve terms which expire October 1,
1985. Members appointed to even-numbered places shall
serve terms which expire October 1, 1984. Thereafter, mem-
bers shall serve two=year terms. No member shall serve
more than three consecutive two-year terms, and the terms
of current members of the commission shall be counted to-
ward the limit of terms to be served for purposes of this
ordinance."

SECTION 3.
That Chapter 28, Article III, "City Plan Commission", of the
Code of the City of Fort Worth (1964), as amended, is hereby amended
by changing Section 28-14 thereof to read and be as follows:
"Sec. 28-14. Meetings and quorum.
"Six (6) members of the commission shall constitute a
quorum for the conduct of business. The members of the
commission shall regularly attend meetings and public
hearings of the commission and shall serve without compen-
sation except for reimbursement for authorized expenses
attendant to the performance of their duties."
,SECTION 4a
That the City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the caption
in the minutes of the City Council and by filing the ordinance in
the ordinance records of the City.
SECTION 5.
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1964),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinance .and such code,
in which event conflicting provisions of such ordinances and such
code are hereby repealed..

SECTION 6.
That it is hereby declared to be the intention of the City
Council of the City of Fort Worth, Texas, that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are
severable, and, if any section, paragraph, sentence, clause or
phrase of this ordinance shall be declared void, ineffective or
unconstitutional by the valid judgment or final decree of a court of
competent jurisdiction, such voidness., ineffectiveness or unconsti-
tutionality shall not affect any of the remaining sections, para-
graphs, sentences, clauses or phrases of this ordinance since the
same would have been enacted by the City Council without the incor-
poration herein of any such void, ineffective or unconstitutional
section, paragraph, sentence, clause or phrase.

SECTION 7.
This ordinance shall be in full force and effect from and after
the date of passage.

Background
On March 15, 1983, the City Council approved Ordinance No. 8758, "Rules for
Boards and Commissions". That ordinance establishes nine membership places for
each City board, unless membership is governed by conflicting State Law, City
Charter provision, or Council exception. It also provides for two-year,
staggered terms for board members. The City Plan Commission is currently
composed of seven members. The attached ordinance provides for nine members,
adds the new provision that no member shall serve more than three consecutive
terms and maintains the existence of staggered, two-year terms for members of
the City Plan Commission.
Recommendation
It is recommended that the attached ordinance be adopted, amending Chapter 28,
Article III of the City Code, City Plan Commission, establishing nine member-
ship places for the City Plan Commission, limiting members' service to three
consecutive terms and maintaining the current staggered two-year terms for
members.
