HomeMy WebLinkAboutOrdinance 2652 ORDINANCE N0, (� L AN ORDINANCE PERMITTING HENRY REPLIN, HIS HEIRS AND ASSIGNS, TO LEAVE THE EXISTING LUCERNE APARTMENT BUILDING, AND STEP ENCROACHM NITS FOR A 114XIN1JM DIS- TANCE OF SIX AND ONE-HALF (6-1/2) FEET IN PENNSILVANIA AVENUE ALONG THE SOUTH LINE OF LOTS 15, 16 AND 232 BLOCK 44, J NN'INGS SOUTH ADDITION TO THE CITY OF FORT WORTH, TAROT COUNTY, TEXAS. k'HEREAS, Henry Replin is the owner of Lots 15, 16 and 23, Block 44, Jei- ings South Addition to the City of Fort Worth, Tarrant County, Texas, along the south line of which property encroachments exist in Pennsylvania Avenue; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1, That Henry Replin, the ovmer of said land above described and the improvements thereon, or his heirs or assigns, be permitted to leave ex- isting building and step encroachments for a maximum distance of six and one-half (6-1/2) feet in Pennsylvania Avenue along the south line of Lots 151 16 and 23, Block 44, Jennings South Addition to the City of Fort Worth, Tarrant County, Texas; and that said improvements on said above described real property be allowed to stand during the life of said building as same are now constructed, provided, however, that in the event such building be demolished or major alterations and repairs be made to said building in the future, same be reconstructed to meet the requirements of the limits of the above mentioned street. SECTION 2, That this ordinance shall take effect and be in full force and of-- feet from and after the date of its passage, and it is so ordained, APPROVED AS TO FORPI: V?,A. City Attorney TO THE HONORABLE IMYOR AND CITY COUNCIL OF THE CITY OF FORT WORTH: HENRY REPLIN, at the present time, a resident of the City of Denver, Colorado, respectfully= prays your Honorable Body to grant an ordi- nance permitting the petitioner herein to retain a building (The Lucerne Apartments), as it now encroaches upon Pennsylvania Avenue in the City of Fort Worth. This encroachment is more particularly described as follows: An encroachment of a maximum of 2.4.2 feet extending from the S. E. corner of Lot 23, Block 44, of Jennings South Addition along the south line of said lot 23.04 feet. In addition 'to the above encroachment there are steps on the ground floor extending 4 feet farther into the street and balconies above the ground floor extending said distance into the street. In addition to the above encroachments there are steps and balconies of 4 feet extending into the street on the S. W. corner of said lot. Your petitioner would further show that said encroachment has ex- isted since about the year 1919 and said building as it is-now located has been used as an apartment house since that date. Your petitioner would further show that he has a contract to purchase the Lucerne Apartments which are located on Lots 15, 16, and 23, Block 44, of Jennings South Addition and that he has applied to Home Life Insurance Company of New York to consummate a loan of $165,000.00 as part of the purchase price for the property. The petitioner would further show that the lending company above mentioned re- quires as a condition to the loan, that the ordinance requested above be granted. The petitioner would further show that at the time the building was erected, no objection thereto was then advanced by the City Authorities. For a fuller understanding of the matter your petitioner hereto attaches a plat or ,sketch of the property which was prepared by Brookes Baker, Civil Engineer.
