MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
HANDLEY—EDERVILLE ROAD
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit:
HANDLEY-EDERVILLE ROAD From Midway Road to twenty-feet south of Jack
Newell Boulevard South, known and designated
as Project No. 30-036688-00, a seven-inch
thick reinforced concrete pavement with a
seven-inch high attached concrete curb on a
six-inch thick cement modified subgrade, so
that the finished roadway will be sixty-feet
wide. Six-inch thick concrete driveway ap-
proaches will be constructed where required
and seven-inch thick reinforced concrete curb
openings at private street intersections.
together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewersland drains and other necessary incidentals and appurtenances; all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made and
entered into with Newell/Eby Joint Venture
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT:
I.
Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:

The estimated cost of improvements is $ 946,387.35 ; the estimated amount
per front foot to be assessed against abutting property and the owners thereof for

be assessed against abutting property and the owners thereof for pavement is $ 63.24
the estimated amount per front foot to be assessed against abutting property and the

amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ 2.94 per square foot; the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $ 75.75 * , plus the cost incurred for concrete driveway construction
where specified.

of Fort Worth, Texas , to all. owning or claiming; any property abutting upon said

at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be .improved is listed as "unknown" on the then current City of
Fort Worth tax rolls, or the name of an ownaL is shown on the City of Fort Worth
tax rolls but no address for such owner is s'aown, no notice need be mailed. In
those cases where the owner is shown to he an estate, the mailed notice may be
addressed to such estate. In this connection , the City Secretary shall prepare
and file or cause to be prepared and filed with hese proceedings a list of the
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses dete~.mined is aforesaid of the respective owners and those peri
sons owning or clairrig any interest in said property.
The City Secret.ary shall certify that zach of the parties in said list whose
address is shown on the then current rendered or unrerdered tax rolls of the City
of Fort Worth was mailed a copy of tho notice c,E hearing and shall further certify
the date or dates on which said (notice wa= mail-d . A copy of each notice shall be
attached to such certificate. The ce.rtificate of the City Secretary will be con-
clusive evidence of the facts therein recited,
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

$912,569.30, based on their overall low bid for Units I and II ;
E. making appropriation to cover the indebtedness thereby incurred for
improvements of the project named above;

HANDLE Y-E DERVI LLE ROAD — °r
BACKGROUND
On May 11, 1982 (M&C C-6301) , the City Council authorized a Community
Facilities Agreement with Lowgar Properties, a General Partnership, for the
development of Lots 1 and 2, Block 1, Northeast Industrial Park Addition. A
segment of Handley-Ederville Road is a border street to the development. On
December 21, 1982 (M&C C-6676) , a Community Facilities Agreement was authorized
with Newell and Newell Limited Partnership, for the development of Lot 1, Block
10, 11 and 12, Newell and Newell Business Park Addition, to which a segment of
Handley-Ederville Road is also a border street. Finally, on March 12, 1985
(M&C C-8979) , as amended by M&C C-8979, dated April 23, 1985, a Community
Facilities Agreement was authorized with Newell and Newell Limited Partnership
for the development of portions of Riverbend West Business Park and Riverbend
East Office Park Additions. Contemporaneous with the agreement is the
assessment paving of Handley-Ederville Road from Midway Road to Jack Newell
Boulevard South. Also included is the construction of a 16-inch water
distribution main in Handley-Ederville Road.

IMPROVEMENTS
Unit I consists of the installation of a new 16-inch ductile iron water
distribution main complete with required appurtenances.
Unit II consists of the construction of 7-inch thick reinforced concrete
pavement with attached concrete curb and driveway approaches where required.
Also included are 7-inch thick reinforced concrete approaches to private
streets on the east side of Handley-Ederville Road. Storm drain improvements
consist of 3,417 feet of reinforced concrete pipe and appurtenances. In
addition, required street lighting will also be installed in a future contract
and/or by City forces upon completion of the paving. However,, adjacent property
owners will be assessed for the street lighting at this time based on the
engineer' s estimate of probable cost.

RECEIPT OF BIDS
The project was advertised for bids on June 27 and July 4, 1985, and the
following bids were received on July 18, 1985, with 117 working days allotted
to complete the project. Paragraph 2, of the Special Provisions in the bid
proposal , indicated that "The City intends to award one contract to the overall
low bidder."

PROJECT COST AND FINANCING
Sufficient funds are available for Unit I, 16-Inch Water Main Handley-Ederville
Road, in Fund 57, Project No. 61s_956-8fl to provide for this contract.

For Unit II, based on the low bid of $832,829.30 for street and storm drain
improvements and the engineer' s estimate of $55,260.00 for street lighting,
approximately $526,641.01 is proposed to be assessed against adjacent
properties. Of this amount ($526,641.01), $253,867.21 will be paid in cash by
the developer and deposited in the project account prior to the contract
award. The remaining assessment of $272,773.80 will be provided for by a bond
fund transfer from the Special Assessments Unspecified Account, 94-009905-00.
Cost to the City for construction is approximately $361,448.29, of which
$133,690. 79 is for street improvements, $207,327.50 for storm drain facilities,
$20,430.00 for street lights plus $58,298.05 (7%) engineering. Bond fund
transfers are required from appropriate unspecified accounts to supplement
available funds in the construction and street light project accounts.
Sufficient funds are available in Fund 13, Project No. 095101-00, for the
City's engineering cost.
