Home My WebLink AboutOrdinance 8838ORDINANCE N0. __ ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF U.S. HIGHWAY 377 AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS, DECLARING THE CONTRACT WITH STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPOR- TATION FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED, DIRECTING THE ISSU- ANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIV- ING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECT- ING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with State Department of Highways and Public Transportation, for the making and construction of certain street improvements on the herein- after described portions of the streets, avenues and public places in said City, to-wit: U.S. HIGHWAY 377 From Mary's Creek northeast to State Highway 183, known and designated as Unit 1, Project No. 021-023-178-00, a six-inch thick concrete surface on a five-lane sixty-foot roadway. Storm sewers and concrete curb and driveways will be constructed where specified. ~. WHEREAS, by sundry proceedings heretofore pa3sed by the City Council of the Gity of Fort Worth, Texas, including Ordinance No, 8198 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, wHE~t~;AS, the City Council of the City of Fort ~'+orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No, 8198 , and YdH~;kir:A3, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in comglete accordance Vrith the contract therefor; NU6u', TtiEhEF'ORE, BE IN ORDAINED ~3Y THE CITY COUNCIL OF TtiE CITY OF FORT WORTH, TEXr'~S, THAT Ie The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance Urith the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the. assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after diving effect to such credit, if any, are hereby enumerated and itemized as foliowsr III, When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract prices IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City, V. Width - Feet IU.S. Highway 377 Mary's Creek Northeast to 60 State Highway 183 (Traffic Circle) 100 Origin of Project On August 26, 1980 (M&C C-5237), the City of Fort Worth entered into an agreement with the State Department of Highways and Public Transportation (SDHPT) wherein the SDHPT agreed to improve or have improved subject roadway and pay for the cost of widening and paving the surface of the roadway. The City agreed to pay the cost of curbs, gutters, driveways, storm sewers, and utility adjustments with a portion of the City's cost being assessed against the owners of abutting property. Assessments were for concrete curb and driveway approaches where none existed. Project Cost and Financing This project has now been completed and accepted by the State Department of Highways and Public Transportation. The City's final share of cost is "'~ $244,445.06 of~"which $34,128.90 is assessed against adjacent properties.
