HomeMy WebLinkAboutOrdinance 8741,~7r 's i..< ~' s^^~ -~, ORDINANCE NO. ~ ---- AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE- MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVI~MENTS ON A PORTION OF WESTVIEW AVENUE AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACiE FOR HEARING TO THE OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING, AND DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDi[NANCE RECORDS OF THE CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Fort Worth, Texas, h;as heretofore ordered that each of the hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im- proved by raising, grading and filling same and by constructing thereon the following, to-wit WESTVIEW AVENUE From West Fifth Street to 300' North of Monticello Drive, known and designated as Project No 029-040•-110, Unit II, a six- irich thick hot-mix asphaltic concrete pave- ment surface on a s:ix-inch thick lime stab- ilized subgrade with seven-inch high con- crete curb and eighteen-inch wide concrete gutter on a thirty-:Feet wide roadway. Six- inch thick driveway approaches will be con- structed where specified together with concrete curbs, gutters, driveways and incidentals to such improvements on proper grade and line where same are not already so constructed, together with storm sewers and drains and other necessary incidentals and appurtenances; all of said im- provements to be constructed as and where shown on the Plains and in strict accordance with the Plans and Specifications therefor, contract therefore has been made and entered into with HARROD PAVING COrTPANY. INC._ __ __ and WHEREAS, the City Council of the City of Fort Worth, '.texas, has caused the Public Works Director to prepare and file estimates of the cost o;E such improvements and estimates of the amount per front foot proposed to bE assessed against abutting property and the owners thereof, and such estimates have been examined, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOR7P WORTH, TEXAS, THAT: I. Such estimates be, and they are hereby adopted and approvecl. II. It is hereby found and determined that the cost of improvements on each portion of streets, avenues, and public places hereinafter described, with the amount or amounts per front foot proposed to be assessed for such improvement:a against abutting pro- perty and the owners thereof, are as follows, to-wit: WESTVIEW AVENUE From West Fi:Eth Street to 300' North of Monticello Drive, known and designated as Project No. 029-040-110, Unit II. The estimated cost of improvements is $ 139,461.85 the estimated amount per front foot to be assessed against abutting property and the owners thereof for concrete curb and gutter is $ 3.01 the estimated amount per front foot to be assessed against abutting property and the owners thereof for pavement is $ -0- the estimated amount per front foot to be assessed against abutting property and the owners thereof for -0- wide concrete sidewalk is $ -0- the estimated amount per square foot to be assessed against abutting property and the owners thereof for six-inch thick concrete driveway is $ 2.39 per :square foot, the total est;mated amount per front foot to be assessed against abutting property and the owners thereof is $ 5.40 , plus the cost incurred for concrete driveway construction where specified. .~~, - : ~ ~.. ti, Y- xli. A hearing be given and held by and before the City Council of the City of Fort Worth, Texas, to all owning or claiming any property abutting upon said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such hearing shall be given and held on the 15th day of March ~, 19 83 at 10:00 a.m~ in the Council Chamber in the City Hall in the City of Fort Worth, Texas, and the City Secretary is hereby directed to give or cause tee be given notice ,of the time and place of such hearing and of other matters and f'.acts in accordance with the terms and provisions of an Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Session, now being known as Article 1105b of Vern;on's Texas Civil Statutes as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1, emergency effective May 12, 1967 Such notice shall be bey advertisement inserted at least three (3) times in a newspaper published in the City of Fort Worth, Texas, the first publication to be made at least twenty-erne (21) days before the date of said hearing.- Said notice shall comply with and be in accordance with the terms and provisions of said Act as amended The City Secretary is further directed to give or cause to be given personal notice of the time and place of such hearing to all owning or claiming any property abutting on said portions of highways, streets, avenues and public places, as well as to all owning or claiming any interest in any such property. Such personal notice shall be in writing and shall be given or caused to be given by the City Secretary by depositing such written notice in the United States Maid at least fourteen (14) days before the date of the hearing, postage prepaid, iti envelopes addressed to all persons own3~ng or claiming any interest in the respective properties abutting the high- ways, streets, avenues and public places or portions the~•eof to be improved, as the names bf such persons are shown on the current rendered tax rolls of the City of Fort Worth and at the addresses so shown, or if the name of such respective owners do not appear on such rendered tax rolls, then address to such owners as their names are shown on the current unrendered tax rolls of the City of Fort Worth at the addresses shown thereon. In those cases in which an owner of property abutting a highway, street, avenue or public place or pox•tion or portions there- of which is to be improved is Iisted as "unknown11 on the then current City of Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth tax iblls but no address for such owner is shown, no notice need be mailed. In those cases where the owner is shown to be an estate, the: mailed notice may be addressed to such estate. In this connection, the City Secretary shall prepare and file or cause to be prepared and filed with these proceedings a list of the properties to be assessed, the names of those persons owning or claiming any interest in said properties to whom the notice was mailed',, together with the last known addresses determined as aforesaid of the respective: owners and those pers sons owning or claiming any interest in said property The City Secretary shall certify that. each of the parties in said list whose address is shown on the then current rendered or. unrendeg•ed tax rolls of the City of Fort Worth was mailed a copy of the notice of hearing and shall further certify the date or dates on which said notice was mailed A copy of each notice shall be attached to such certificate, The certificate of the City Secretary will be con- clusive evidence of the facts therein recited. d~ . - s .. Monticello Virginia Place 30 60 Drive to Rivercrest Dr. i Origin of Project On November 5, 1980 (M&C G-4750), the City Council authorized the Director of of Transportation and Public Works to proceed with the design of priority local residential streets of which Rivercrest Drive (West Seventh to Monticello) and Westview Avenue (West Fifth to Monticello} were included as priority 11 and 7, respectively. There is also a need to improve an additional block of Rivercrest Drive from Monticello to White ;Settlement Road as well as the segment (2 blocks) of ~ Monticello Drive from ,Virginia Place to Rivercrest Drive. On August 18, 1981 (M&C C-5826), the City Council awarded an engineering contract to the firm of Mandell and Hiller, Inc., to prepare plans and specifications for this project to include the additional street segments outlined abcive. Improvements Units I and III Improvements will consist of resurfacing the entire roadways with spot base repair and minor replacement of deteriorated curb and gutter. No assessments are proposed on these units since ,gall curb and gutter and driveway approaches are existing. Unit II Improvements will consist of reconstructing the existing pavement and base as well as constructing new curb and gutter, plus driveway approaches where required. Assessments are proposed for curb and gutter and/or gutter only as well as driveway approaches where none now exist. ~"~!~#. i DATE REFERENCE SUBJECT Contract Award Resurfacing PAGE NUMBER 2/15/83 **C-6765 and Reconstruction of Rivercrest Drive 2 of3 Westview Avenue and Monticello Drive Unit IV: Improvements will consist of reconstructing the existing pavement and base, replacement of deteriorated curb and gutter, driveway approaches and sidewalks, and intersection improvements at Westview Avenue and Rivercrest Drive. No assessments are proposed on this unit since all facilities are existing. Receipt of Bids The project was advertised for bids on January 6 and 13, 1983, and the following bids were received on January 27, 1983, with 55 working days allotted to complete the project. Grimes & Company, Inc. 280,766.85 Stolaruk Corp. 281,118.66 Austin Road Company 295,804.70 SRO Asphalt, Inc. 297,218.68 APAC-Texas, Inc. 310,571.46 Assessments and Financing Standard City policy in effect at the time this project was brought to the attention of the property owners stated that under street reconstruction, residentially zoned property would not be assessed any portion of the cost except for non-existing curb and gutter and/or gutter only and driveway approaches. Units I, III and IV of this project have all existing facilities, consequently the only assessments proposed are on Westview Avenue, Unit II. Adjacent property owners will be assessed for curb and gutter and/or gutter only, plus driveway approaches where none now exist. The assessment rate is based on one-half the normal rate in that the street being improved is at the rear of all the properties. Such assessments amount to approximately $9,403.34. This amount will be provided for by a bond fund transfer from the "Revolving Fund Unspecified" account. Cost to the City for Unit II is $117,380.16, plus $12,678.35 (10~) engineering. Cost to the City for all Units is approximately $253,764.66, plus $26,316.80 (10%) engineering. Bond fund transfers are required from "General Residential Streets Unspecified" account for the City's construction cost and from the "Engineering Unspecified" account to supplement the engineering funds in the project account.
