ORDINANCE ,NO. ~~~~
AN ORDINANCE AMENDING SECTION 16-12.1 OF CHAPTER 16 OF THE
CODE OF THE CITY OF FORT WORTH, TEXAS (1964), AS AMENDED,
TO REQUIRE A DEPOSIT FROM RESIDENTIAL REFUSE COLLECTION
CUSTOMERS; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF EXISTING ORDINANCES; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY
CLAUSE; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL
THIS ORDINANCE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 16-12.1 of Chapter 16 of the Code of the City of
Fort Worth, Texas (1964), as amended, be amended be and the same is
hereby amended to read as follows:
"Section 16-12.1 - Deposit required.
All commercial customers shall be required to make a
deposit, in advance, of an amount equal to three months'
refuse collection fees. All residential customers shall be
required to make a minimum deposit of $10.00, in advance,
or an amount of money which will, in the judgment of the
Director of the City Services Department, be sufficient to
insure the City against loss due to non-payment of final
bill."
SECTION 2.
This ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1964),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinances and such
Code, in which event conflicting provisions of such ordinances and
such Code are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction,•such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 4.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
Section 1 in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 5.
This ordinance shall become effective and be in full force and
effect from and after the date of its passage, and it is so
ordained.

Background
During the 1982-83 budget review sessions, the City Council approved the
concept of collecting deposits for residential refuse collection; however..,
collection of deposits was not able to be initiated until changes in the
billing and records systems were completed by the Data Processing Department.
'Data Processing has now completed the required work.
It is proposed that deposits be collected for all new customers and those
current customers requesting changes in service who have unpaid bills or who
have a history of not paying their bills for refuse collection in a timely
manner. The amount of the deposit will be a minimum of $10.00 or an amount
which will, in the judgment of the Director of City Services, be sufficient
to insure the City ag-ainst loss due to non-payment. It is proposed that
collection of deposits commence October 1, 1983.
Recommendation
It is recommended that an ordinance be adopted requiring deposits for
residential refuse collection as outlined above effective October I, 1983.
