CONTRACT NO.
COUNTIES OF TARRANT §
AND DENTON
1.
This contract is by and between the City of Fort Worth, Grantee, and Women's Haven of
Tarrant County,Inc.,Service Provider,and in aid of Criminal Justice Division Grant Number WF-99-
V30-13414-02,titled Domestic Assault Response Team(DART). It is understood by all parties that
payment obligations created bythis contract are conditioned upon the availability of State orFederal funds
appropriated or allocated for the payment of such obligations.The term of this contract shall commence
on October 1,2000,and shall end on September 30,200 1,unless extended or terminated as otherwise
provided for in this contract.

The GRANTEE AGENCY is responsible for closely monitoring the Service Provider and the exercise
of reasonable care to enforce all terms and conditions of the grant. Service Provider agrees to fully
cooperate in the monitoring process.
3.
Requirements of the Uniform Grant Management Standards(UGMS)promulgated pursuant
to Section 783,of the Government Code are adopted by reference as part of this contract,including the
contract provision as in Section 36, Common Rule of OMB, of the above standards. The GRANTEE
AGENCY shall keep all project records. Records shall be retained for a least THREE (3) YEARS,
following the closure of the most recent audit report and until any outstanding litigation,audit or claim has
been resolved.Records are subject to inspection by CJD,or any state or federal agency authorized to
inspect the same.

The Service Provider will furnish the following:
• Provide emergency shelter to women and children who fear they are in danger of domestic
abuse.
• Provide programs which meet the immediate physical and emotional needs of clients.
• Provide programs for clients which will help curtail the cycle of abuse.
• Provide programs to increase public awareness of domestic abuse and to address issues
relating to its prevention.
• Encourage and coordinate cooperation with other organizations to effect and fulfill the
purposes of Women's Haven of Tarrant County, Inc.

• One Victim Specialist at a salary of$25,138 and fringe benefits of$4,366 for a combined
total of$29,504.
5.
Payment for the above(not to exceed$29,504 of the total amount of the grant)will be made as
follows: a monthly reimbursement request with an itemized statement of expenses.

Billing for the above will be provided in the same manner as it would be provided to institutional
purchasers in the absence of a grant and shall consist of a brief statement of the service or other item
provided and the basis for the billing rate.
7.
In the event of a default of the Service Provider,the GRANTEE AGENCY may cancel or suspend the
contract and the SERVICE PROVIDER shall be entitled to recover for all services provided or materials
delivered prior to the cancellation date(or unused materials may be returned)or shall repay any funds
advanced for services not yet rendered.
8.
All licenses,legal certifications,or inspections required for the services,facilities,equipment,or
materials,and all applicable state and federal laws and local ordinances must be complied with by the
SERVICE PROVIDER. Failure to comply with this requirement shall be treated as a default.
9.
This contract shall automatically terminate on the grant expiration date or any extension date thereof
granted by CJD or upon termination of the underlying grant by CJD.All services billed hereunder must be
rendered within the grant period.
10.
The provisions of this agreement are severable and if for any reason a clause,sentence,paragraph
or other part of this agreement shall be determined to be invalid by a court or federal or state agency,board
or commission having j urisdiction over the subj ect matter thereof,such invalidity shall not affect other
provisions which can be given effect without the invalid provision.

11.
The failure of City or District to insist upon the performance of any term or provision of this
agreement or to exercise any right herein conferred shall not be construed as a waiver or relinquishment
to any extent of City's or District's right to assert or rely upon any such term or right on any future occasion.
12.
Should any action, whether real or asserted, at law or in equity, arise out of the execution,
performance, attempted performance or non-performance of this contract and agreement, venue for
said action shall lie in Tarrant County, Texas.
13.
This written instrument constitutes the entire agreement by the parties hereto concerning the
work and services to be performed hereunder, and any prior or contemporaneous, oral or written
agreement which purports to vary from the terms hereof shall be void.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to accept, if awarded, two grants from the Governor's Office, Criminal
Justice Division in the amount of $158,304; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Special Trust Fund, Awarded Assets, by $95,647 from available funds; and
3. Authorize the transfer of $95,647 from the Special Trust Fund, Awarded Assets, to the Grants Fund
for the City's match; and
4. Authorize the use of $34,278 in time donated by volunteers as in-kind match; and
5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund by $288,229 subject to receipt of the grant; and
6. Enter into a contract with Women's Haven of Tarrant County for an amount not to exceed $29,550; and
7. Waive indirect costs in the amount of $41,634.
DISCUSSION:
Last year, the Criminal Justice Division (CJD) informed us that this year we would not need to submit a
formal application for the two grants listed below because of the 3-year application policy instituted by
the CJD. Under this plan, grantees selected by their regional criminal justice advisory committee to
receive a 3-year commitment are automatically recommended for continued funding subject to
performance, compliance with CJD rules, and availability of funds.
The two grants listed below were selected by the North Central Texas Council of Governments to
receive funding consideration under the 3-year commitment policy.
Domestic Assault Response Team (DART)/3
The Domestic Assault Response Team (DART) program will continue to operate teams consisting of
a family violence detective and a trained crisis intervention volunteer in the East and North Field
Operations Divisions, and when necessary, in the South and West Field Operations Divisions.
DART activities include crisis intervention, information and referral, and facilitation of emergency
shelter admissions when indicated. Victim's services will be provided through the human services
administrator, administrative secretary, the victim's services specialist and DART volunteers. In
1999, the DART program served 317 primary victims and 385 secondary victims. Of those served,
242 were male and 460 were female. The ages of the victims ranged from 0 to 60-plus.

This program began in October 1996 as a collaboration between the Family Violence Unit and
Women's Haven of Tarrant County. The current contractual monies are for the salary of the victim
specialist provided by Women's Haven of Tarrant County. This person is primarily responsible for
training the volunteers to be used for the program, for developing and maintaining case files as well
as volunteer files. This person is also responsible for the development, documentation, and
expansion of victim assistance/follow-up services, evaluation of data dealing with victim's services,
job performance of volunteers and various other duties.
Enhanced Domestic Assault Response Team/3
This program primarily provides the salaries for the two detectives who are assigned to the program
and ride with a trained crisis intervention volunteer. The detectives will continue working closely with
the personnel assigned to the DART program. The teams respond to domestic violence calls in the
North and East Field Operations Divisions. Additionally, the detectives will respond, when necessary,
to domestic violence calls in the South and West Field Operations Divisions. The teams will
continue to provide crisis intervention, information and referral, facilitation of emergency shelter
admissions when indicated, comprehensive evidence gathering and investigation, and patrol relief at
the scene in a timely manner when the law enforcement process is complete.

Since the maximum award for the Domestic Assault Response Team and Enhanced Domestic Assault
Response Team is $80,000 each, it is necessary to waive the indirect costs in the amount of $41,634
($16,546 and $25,088, respectively). Additionally, the CJD has mandated that in the event of any
misuse or loss of issued CJD funds, the City will replace these funds in full.
The in-kind match of $34,278 is time donated by the volunteers.
