SECOND AMENDMENT TO CITY OF FORT WORTH
CITY SECRETARY CONTRACT NO. 17205
WATER SERVICE BETWEEN THE CITY OF WESTWORTH VILLAGE
AND THE CITY OF FORT WORTH
WHEREAS, on April 1, 1989, the City of Fort Worth and the City Westworth
Village made and entered into City of Fort Worth City Secretary Contract No.17205,
whereby the City of Fort Worth agreed to provide treated water service to Westworth
Village; and
WHEREAS, on July 2, 1991, the City of Fort Worth and the City of Westworth
Village entered into the First Amendment to City of Fort Worth City Secretary No.
17205, such amendment being City of Fort Worth City Secretary Contract No. 18576;
and
WHEREAS, the City of Westworth Village has requested an additional point of
connection to the Fort Worth System for the purpose of taking treated water; and
WHEREAS, the City of Fort Worth desires to authorize an additional connection
to the Fort Worth System for the City of Westworth Village.
NOW, THEREFORE, KNOW ALHESE PRESENTS:

This second amendment to ty of Fort Worth City Secretary Contract No. 17205
is made and entered into this 4a -,4-leek, 2000 by the City of Fort Worth, a
municipal corporation located in Tarrant and Denton Counties, acting herein by and
through Mike Groomer, its duly authorized Assistant City Manager, hereinafter referred
to as "Fort Worth", and the City of Westworth Village, a municipal corporation located in
Tarrant County. Texas, acting herein by and through James B. Parnell, its duly authorized
Mayor, hereinafter referred to as "Customer".

Paragraph 3 of City of Fort Worth City Secretary Contract No. 17205 is hereby
amended by adding a new paragraph 3.5, which shall be and read as follows:
3.5 Customer is granted a new point of connection to the Fort Worth
System at Green Oaks Road and Highway 183 in Tarrant County, Texas,
which shall be in the approximate location as shown on Exhibit "B"
attached hereto and made a part hereof for all purposes. The cost of the
installation shall be the sole responsibility of Customer. The meter
installed at such location shall comply with all other terms and conditions
of this contract. Any costs incurred to upgrade the meter to comply with
these provisions shall be the sole responsibility of Customer.

Regardless of its date of execution, this amendment shall take full force and effect
as of October 1, 1999. This amendment shall have no effect on billings for water
delivered to Customer or any third party prior to October 1, 1999.

All other terms and conditions of City Secretary Contract 17205, as amended by
City Secretary Contract No. 18576, not affected hereby remain in full force and effect.

SUBJECT APPROVAL OF SECOND AMENDMENT TO THE AGREEMENT FOR WATER
SERVICE WITH THE CITY OF WESTWORTH VILLAGE
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute the second amendment
to the Agreement for Water Service between the City of Westworth Village and the City of Fort Worth,
granting a new point of connection at Green Oaks Road and SH 183.
DISCUSSION:
The Westworth Redevelopment Authority assumed responsibility for the water and wastewater
accounts previously billed to Carswell Air Force Base and the Naval Air Station Joint Reserve Base in
October 1998. Water service to that area is provided through a meter located at Green Oaks Road and
SH183. Through discussions involving Fort Worth and Westworth Village staff, it was determined that
F the Westworth Redevelopment Authority and Westworth Village accounts should be combined.
F This amendment will provide for the addition of the Green Oaks Road connection to the Westworth
Village Uniform Wholesale Water contract. Amendment No. 1 to this contract provided for the collection
of impact fees and was executed in 1991.
Wastewater service to this area is calculated on a per-connection basis, and will also be included in the
wholesale billing to Westworth Village.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that the Water Department, Customer Service Division is responsible for
the collection of fees due to the City under this agreement.
