ORDINANCE NO. ~ ~~'~
AN ORDINANCE DELETING ORDINANCE NO. 8212 AND AMENDING
+ ORDINANCE NO. 8140 WHICH ADOPTED THE UNIFORM PLUMBING
CODE, AS AMENDED, BY AMENDING SECTION 1211 CONCERNING
LOCATION OF GAS METERS; PROVIDING FOR THIS ORDINANCE TO BE
CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR
PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS;

SECTION 1.
That Ordinance No. 8140, the Uniform Plumbing Code, as amended,
is hereby amended by revising Section 1211 thereof to read as fol-
1 ows : -~
"SEC. 1211 - GAS METER LOCATIONS
"(a) All gas meter locations shall be approved by
the Administrative Authority and the serving gas supplier.
" (b ) Where more than one (1) meter is set on a par-
ticular premise, they shall all be set at one location,
except where this is impractical. In multiple meter in-
stallations each separate gas piping system shall be iden-
tified by the permittee in a manner satisfactory to the
serving gas supplier.
"(c) All gas meters shall be preceded by a main sup-
ply shut-off valve and shall be so placed as to be at all
times readily accessible for inspection, reading, testing
and shutting off the gas supply. All service piping or
main supply shut-off valves must be outside of the build-
ing and readily accessible.
"(d) In order that gas may be supplied, the gas
pipeline inlet shall be located with respect to the pro-
posed meter location, in accordance with the local serving
gas supplier instructions.
"(e) Access to the enclosed meters shall be through
an opening or door not less in size than twenty-two (22)
inches by twenty-four (24) inches, but in no event smaller
than that specified by the local serving gas supplier.
"(f) Gas meters shall not be located under a show
window or under interior stairways or in engine, boiler,
heater or electric meter rooms. Where not prohibited by
other regulation, gas meters may be located in the open
under exterior stairways.
"(g) Whenever pot meters serving one (1), two (2),
three (3), or four (4) family dwellings and located on
public property in front of those dwellings are replaced',
such replacement may be done by one of two options
selected by the property owner.

"Option 1. The gas service supplier shall move
the meter to the building and, when necessary,
replace the yard gas service line from the gas
main to the gas meter measuring point - all with-
out charge to the gas customer except as approved
by the City Council through the gas rate struc-
ture. The gas service riser on the customer side
and the connection thereof to the house piping
shall be the responsibility and the expense of the
property owner.
"Option 2. In the event the owner does not desire
to have the meter so located by the building and/
or does not choose to pay for such location at the
building, the gas service supplier shall locate
the meter at the property line on the owner's side
and shall install both gas meter risers without
charge to the customer except as approved by the
City Council through the gas rate structure.
"The customer may have the option, at his/her ex-
pense, to obtain a plumber to do all of the work, but all
materials must meet the minimum requirements set by the
City.
"(h) The initial installation of all gas lines with-
in the customer's property line shall be the responsi-
bility of the customer. Thereafter the serving gas sup-
plier shall be responsible for maintenance of the service
line. A service line is defined as a gas pipe extending
from the serving gas supplier's main to the gas meter
measuring point on the customer's property. When existing
service lines need repair or replacement, the serving gas
supplier shall do so without charge to the customer except
as approved by the City Council through the gas rate
structure. PROVIDED in cases where the existing gas ser-
vice line enters directly under the house, beneath the
surface of the ground, the owner shall at his/her own ex-
pense install a riser outside the building and connect the
same to the existing house piping.
"(i) When a pot meter is replaced and relocated to
the building, a pressure test of no less than five pounds
of pressure shall be placed upon the owner's side of the
gas piping system.
"(j) When the meter is located at the property line,
a meter check test with a minimum of 5 ounces shall be
placed upon the system."
SECTION 2.
That this ordinance shall be cumulative of all ordinances, ex-
cept where the provisions of this ordinance are in direct conflict
with the provisions of such ordinances, in which event conflicting
provisions of such ordinances are hereby repealed.
SECTION 3.
That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and

phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentence, paragraphs and sec-
tions of this ordinance, since the same would have been enacted by
the City Council without the incorporation in this ordinance of any
such unconstitutional phrase, clause, sentence, paragraph or sec-
tion.
SECTION 4.
That all rights or remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of Ordinance
No. 8140, as amended, and as to any other ordinance affecting plumb-
ing which have occurred at the time of the effective date of this
ordinance; and, as to such accrued violations and all pending liti-
gation, both civil and criminal, whether pending in court or not,
under such ordinances, same shall not be affected by this ordinance
but may be prosecuted until final disposition by the courts.
SECTION 5.
That any person violating any of the provisions of this ordi-
nance shall be deemed guilty of a misdemeanor, and each such person
shall be guilty of a separate offense for each day or portion there-
of during which any violation of any provisions of this ordinance is
committed, continued or permitted, and each violation shall be pun-
ishable by a fine not exceeding Two Hundred Dollars ($200).
SECTION 6.
That the City Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption, penalty clause and effective
date of this ordinance for five (5) days in the official newspaper
of the City of Fort Worth, as authorized by TEX. REV. CIV. STATS.,
Art. 1176b-1.

SECTION 7.
That this ordinance shall be in full force and effect from and
after the date of passage and publication as above specified.

Informal Report No 6852 (June 16, 1983), discussed three proposals to resolve
the pot meter controversy covered by the present Plumbing Code. The City Council
concurred with the third option in order to eliminate confusion surrounding
replacements and relocation of gas meters by Lone Star Gas Company
The proposed amendment would provide the following
A Whenever a pot meter is replaced, such replacement may be done by one of two
options selected by the property owner.
Owner 1: The gas service supplier shall relocate the meter above ground
next to the building and, when necessary, replace the yard gas line. The
gas service risers on the house side of the meter will be installed at
the owner's expense.
Option 2• The gas service supplier shall locate the meter at the property
line on the owner's side and shall install both gas meter risers without
charge,
B When a meter is relocated next to a building, a pressure test of no less
than five pounds of pressure shall be placed upon the owner's side of the
gas piping system.
C When the meter is located at the property line, a meter check test with
minimum of five ounces shall be placed upon the system
D Repairs or maintenance by the owner upon his/her house piping system shall
be at the owner's expense.
This proposal was reviewed by representatives of the Community Development
Council, Plumbing Advisory Board, and Lone Star Gas Company City staff have
reviewed this proposal The Department of Law has prepared the attached
ordinance based upon the recommendation from the above groups.
