HomeMy WebLinkAboutOrdinance 18057-04-2008Ordinance No. 18057-04-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $980,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING AN ENGINEERING AGREEMENT WITH TRANSYSTEMS CORPORATION D/B/A TRANSYSTEMS CORPORATION CONSULTANTS FOR STORM WATER AND FRANCHISE UTILITY RELOCATIONS FOR THE TRINITY RIVER VISION-CENTRAL CITY PROJECT AND THE TRINITY UPTOWN SERVICE AREA, PHASE 1A-BRIDGE AND CHANNEL RELOCATIONS (CITY PROJECT NO. 00969); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $980,000 from available funds for the purpose executing an engineering agreement with TranSystems Corporation d/b/a TranSystems Corporation Consultants for storm water and franchise utility relocations for the Trinity River Vision-Central City Project and the Trinity Uptown Service Area, phase 1 a- bridge and channel relocations (City Project No. 00969). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Capital Project Reserve Fund by $980,000 from available funds; 2. Authorize the transfer of $980,000 from the Capital Project Reserve Fund to the Specially Funded Capital Projects Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Specially Funded Capital Projects Fund in the amount of $980,000; and 4. Authorize the City Manager to execute an engineering agreement with TranSystems Corporation, d/b/a TranSystems Corporation Consultants, in the amount of $946,500 for Storm Water and Franchise Utility Relocations for the Trinity River Vision-Central City Project and the Trinity Uptown Service Area, Phase 1A -Bridge and Channel Relocations. DISCUSSION: In order to facilitate the construction of the Trinity River Vision (TRV) -Central City Project and the area defined as the Trinity Uptown Project, it is necessary to relocate all existing storm water systems located within the TRV project area. The proposed scope of services includes the following: • Development of a long term management plan for the TRV project that will accommodate current and features storm drainage; • Project management needed to deliver City and franchise utility relocation project contracts to comply with the overall schedule for the TRV project; • Detailed utility system map of the area based on City specifications in GIS format; • Determination of the appropriate storm water extensions to serve new development along the channel; Logname: 30TRINITYTRANIA Page 1 of 3 • Development and updating of a critical path timeline for the relocation of all public and private utilities within the TRV project area; and • Design survey for storm drain relocation. In order to commence the relocation of the storm water improvements ahead of the construction of the TRV-projects, the proposed storm water project is divided into the following phases for design and construction purposes: • Storm water and franchise utility relocations for the Trinity River Vision -Central City Project and the Trinity Uptown Service Area, Phases 1A and 1 B- Bridge and Channel Relocations; • Storm water and franchise utility relocations for the Trinity River Vision -Central City Project and the Trinity Uptown Service Area, Phase 2 -Mitigation Areas; and • Storm water and franchise utility relocations for the Trinity River Vision -Central City Project and the Trinity Uptown Service Area, Phase 3 -Bypass Tie-ins, University Drive, Isolation Gates and Samuels Avenue Dam. TranSystems Corporation, d/b/a TranSystems Corporation Consultants, proposes to provide the necessary engineering services for Phase 1A for a lump sum fee of $946,500. City Staff considers the fee to be fair and reasonable for the scope of services proposed. Staff will request City Council approval for Phases 1 B, 2 and 3 via amendments to this agreement as work progresses on the TRV project. In addition to the contract amount $33,500 is required for project management, utility coordination and real property acquisition by the Engineering Department. TranSystems Corporation, d/b/a TranSystems Corporation Consultants, is in compliance with the City's M/WBE Ordinance by committing to 41 percent M/WBE participation. The City's goal on the project is 30 percent. This project is located in COUNCIL DISTRICTS 2 and 9. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and the adoption of the attached appropriation ordinances, funds will be available in the current capital budgets, as appropriated, of the Capital Projects Reserve Fund and the Specially Funded Capital Projects Fund.
