HomeMy WebLinkAboutOrdinance 8759./ i tc' ~ l a ORDINANCE N0. `~~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING THE 7500 BLOCK OF AN UNNAMED STREET LOCATED IMMEDIATELY SOUTH OF AND ADJACENT TO BLOCK 2R, CAROL OAKS NORTH ADDITION AND LOT 22C, BURTON PLACE ADDITON, A WIDTH OF 25', FROM THE WEST RIGHT-OF-WAY LINE OF ENOCH DRIVE EAST TO THE EAST RIGHT-OF-WAY LINE OF BURTON TERRACE; PROVIDING FOR REVER- SION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CON- FLICT HEREWITH AND PROVIDING A.N EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS; SECTION 1. THAT THE 7500 block of an unnamed street located immediately south of and adjacent to Block 2R, Carol Oaks North Addition and Lot 22C, Burton Place Addition and Lot 22C, Burton Place Addition, a width of twenty-five feet (25'), from the west right-of-way line of Enoch Drive east to the east right-of-way line of Burton Terrace, be and the same is vacated, abandoned, and permanently closed as a pub- lic street right-of-way. SECTION 2. That the fee to the land in the above described vacated street right-of-way is hereby released and shall revert to the adjacent owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. The subject street right-of-way, acquired by dedication, is not open on the ground and contains no utility facilities The subject vacation request is made in order to replat the vacated right-of-way with abutting property to expand the building area and provide more usable yard space. A portion of said right-of-way was vacated by the City Council on April 13, 1982, by Ordinance No 8559 (PZ-1124) Reviewing City departm nts and private utility companies have raised no objections to this request provided the vacated right-of-way is replatted with abutting property as development occurs The City Plan Commission has reviewed this request and recommends that the subject street right-of-way ~be vacated as requested Recommendation It is recommended that an Ordinance be adopted vacating the 7500 block of the un-named street, as recommended by the Plan Commission.
