ORDINANCE NO. ~'9S9
AN ORDINANCE APPROPRIATING ADDITIONAL REVENUE OF THE CITY
OF FORT WORTH IN THE AMOUNT OF $40,000.00 FROM THE
UNAPPROPRIATED RETAINED EARNINGS OF THE LAKE WORTH TRUST
FUND, FUND BALANCE RESERVED, TO THE LAKE WORTH TRUST FUND,
ACCOUNT NO. 80-20-10, I.C. 301010, FOR THE PURPOSE OF
PURCHASING THE LEASEHOLD IMPROVEMENTS ON LOT 8, BLOCK 4,
LAKE WORTH LEASE SURVEY; PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDI-
NANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the estimated revenues accruing to the General Fund of the
City of Fort Worth for the Fiscal Year 1983-1984 are hereby increas-
ed by $40,000; and that in addition to providing the City Manager
with such other revenue as may be secured from various sources in-
cluded in Ordinance No. 8886 and in the Budget of the City Manager,
there shall also be appropriated from the unappropriated retained
earnings of the Lake Worth Trust Fund, Fund Balance Reserved, of the
General Fund, the sum of $40,000 to the Lake Worth Trust Fund,
Account No. 80-20-10, I.C. 301010, for the purpose of purchasing the
leasehold improvements on Lot 8, Block 4, Lake Worth Lease Survey.
SECTION 2.
Should any portion, section or part of a section of this
Ordinance be declared invalid, inoperative or void for any reason by
a court of competent jurisdiction, such decision, opinion or judg-
ment shall in no way impair the remaining portions, sections or
parts of sections of this Ordinance, which said remaining provisions
shall be and remain in full force and effect.
SECTION 3.
That this Ordinance shall be cumulative of Ordinance No. 8886,
and all other ordinances and appropriations amending the same except
in those instances where the provisions of this Ordinance are in
direct conflict with such other ordinances and appropriations, in
which instances said conflicting provisions are hereby expressly
repealed.

SECTION 4.
That this Ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

On March 4, 1981 (M&C G-4890), City Council approved the Lake Worth Land Use and
,Management Plan as prepared by Carter and Burgess, Inc. This plan designates
certain areas around Lake Worth for "park" usage. The lease site described as
Lot 8., Block 4, Lake Worth Lease Survey, aka 7709 Cahoba Drive, is situated in a
designated"park" area, and this is the first area scheduled for park conversion
under the aforementioned plan.
The lessee of Lot 8, Block 4, Lake Worth Lease Survey, Herschel Watts, has
expressed a desire to sell the improvements to the City now and rent them back
until such time that the City has need for the land. The Real Property Division
has negotiated a consideration of $40,000 for the improvements with Mr. Watts.
This consideration is supported and justified by a recent appraisal on similar
improvements situated on a lake lease by an independent appraiser in connection
with those improvements approved for purchase at $50,000 on June 28, 1983
(M&C L-7717).
The improvements situated on Lot 8, Block 4, Lake Worth Lease Survey include a
wood frame dwelling containing 1,983 square feet bf living area divided into five
rooms and a large entry hall The interior is comprised of two large, pine-
_ panelled bedrooms, a large pine-panelled den with fireplace, one bath, a kitchen
that has been remodelled within the last 5 or 6 years with pine cabinetry, dining
area, and a separate room now being utilized by Mr. Watts as an office.
Financing:
It is proposed to finance this purchase by appropriating $40,000 from the Lake
Worth Trust Fund, Fund Balance-Reserved, Account No. 311(000542) to General Fund
Account No. 80-20-10, I.C. 301010.
Recommendations
It is recommended that City Council approve
1. Cancellation of the 5-year lease with Herschel L. Watts on Lot 8 Block 4,
Lake Worth Lease Survey, while allowing him to continue o~uQ~~ao~Ya month-
to-month basis for $500 per month, C11Y COUNCIL
2. Purchase of the leasehold improvements from Mr. Watts for ~,~co~~sidge~~tion of
