HomeMy WebLinkAboutOrdinance 8860.. ~~ r~ ; ~ ā€ž '~ ORDINANCE NO. ,f~,b b`' AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING THE 10 FOOT WIDE UTILITY EASE- MENT LOCATED ALONG AND FIVE FEET ON EITHER SIDE OF THE COMMON PROPERTY LINE OF LOTS 2 AND 3, BLOCK 2, GRAMMERCY PLACE ADDITION, AND EXTENDING FROM MANHATTAN BOULEVARD NORTHWARD A DISTANCE OF 242.73 FEET; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. . -~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE 10 foot wide utility easement located in Lots 2 and 3, Block 2, Grammercy Place Addition, said easement being located along and five feet on either side of the common property line of said Lots 2 and 3, and extending from Manhattan Boulevard northward a distance of 242.73 feet, be and the same is vacated, abandoned, and permanently closed and extinguished as a utility easement. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: ~C~ty Attorney ADOPTED : ~ ~,- EFFECTIVE: .~ ~^ r; .~ ~i~~ ~~' 1F'~~~ r~~~~lla., ~ ~.~~~ f ~ DATE REFERENCE SUBJECT' VacatzOri of Utility Easement: PAGE NUMBER 6/28/83 **PZ-1204 Grammercy Place Addition, Block 2, Lots 2 ior.l___.._ Worth Enterprises, Inc owner of all abutting property, has requested that the City vacate the 10' wide utility easement in Block 2, Lots 2 and 3, Grammercy Place Addition, from Manhattan Boulevard northward 242 73' along 5' either side and co-linear with the common property line of said Lots 2 and 3, as shown on the attached map The subject utility easement, acquired by dedication, is platted but contains no utility facilities The subject vacation request is made in order to remove the encumbrance placed on the property by said easement, thus expanding the building area. Reviewing City departments and private utility companies have raised no objections to this request.
