HomeMy WebLinkAboutOrdinance 8862r t .""~~ ., ORDINANCE NO. ~(~ (p AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EX~l'IN- GUISHING THE 10-FOOT WIDE UTILITY EASEMENT LOCATED ALONG AND 5 FEET ON EITHER SIDE OF THE COMMON PROPERTY LINE OF LOTS 27 AND 28, BLOCK 1, HERITAGE OAKS ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH~•--AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 10-foot wide utility easement located along and 5 feet on either side of the common property line of Lots 27 and 28, Block 1, Heritage Oaks- Addition, from 7.5 feet south of the north property lines of said Lots 27 and 28, southeasterly 264.2 feet to Windsor Circle, be and the same is vacated, abandoned and permanent- ly closed and extinguished as a utility easement. SECTION 2. That the fee to the land in the above described vacated utility easement is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. II, Block 1 for 1.__ West of C R. 1085 RAnoN•i Paul A McDeavitt, owner of all abutting property, has requested that the City vacate the 10' wide utility easement in and between Lots 27 and 28, Block 1, Heritage Oaks Addition, from 7.5' south of the north property lines of said Lots 27 and 28, southeasterly 264.2' to Windsor Circle, as shown on the attached map. The subject utility easement, acquired by dedication, is platted but contains no utility facilities. The subject vacation request is made in order to replat the vacated easement with adjacent property to expand the building area and provide more usable yard space. 'Reviewing City departments and private utility companies have raised no ob- jections to this request.
