AND LAND FOR TRADE, INDUSTRY, RESIDENCE OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION, AND FOR SUCH PURPOSES DIVIDING THE MUNICI- PALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGU- LATIONS AND SHOWING SUCH DISTRICT AND T.HE BOUNDARIES THEREOF UPON "DISTRICT MAPS," PROVIDING FOR INTERPRE- TATION, PURPOSE AND CONFLICT; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PRO- VIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENAL CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR PUBLICATION AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011, as amended, is hereby amended so that the permitted uses in the hereinafter described area be altered, changed, and amended as follows: Z-83-196 Being a 9.78 acre tract out of the G. W. Clark Survey, Abstract No. 1812, and being more particularly described as follows: BEGINNING at an iron pin on the west R-O-W of Hunter's Glen Trail, said iron pin being also the Northeast corner of Lot 18 - Block F - Bentley Village Addition Section 3 as recorded in Volume 388-123, Page 16, T.C.P.R.; THENCE SOUTH 19° 07' 28" EAST along said west R-O-W of Hunter's Glen Trail a distance 812.50 feet to an iron pin; THENCE continuing along said west R-O-W of Hunter's Glen Trail a curve to the left having radius bearing North 70° 52'' 32" E 203.90 feet, an arc distance of 94.84 feet to an iron pin, said iron pin being the southeast corner of Lot 10, Block F, Bentley Village Section 3, as recorded in Volume 388-121, Page 16, T.C.P.R.; THENCE SOUTH 47° 20' 46" WEST along the Southeast line of said Lot 10, Block F a distance of 140.04 feet to an iron pin, said iron pin being the Northeast corner of Block M, Bentley Village Section 1, as recorded in Volume 388.97, Page 19, T.C.P.R.; THENCE SOUTH 88° 52' WEST along the North line of said Block M a distance of 403.91 feet to an iron pin on the East R-O-W of Randol Mill Parkway; THENCE along said East R-O-W of Randol Mill Parkway a curve to the left having radius bearing South 76° O1' 48" West 1385.36 feet, an arc length of 647.58 feet to an iron pin on the south R-O-W of Racquet Club Drive; a s ~ i5 Z-83-196 THENCE North 49° 14' 43" East along said South R-0-W of (Cont.) Racquet Club Drive curve to the right having radius bearing South 40° 45' 17" east 437.21, an arc length of 160.13 feet to the point of beginning and containing 9.78 acres of land, more or less. Ballard Survey, Abstract No. 242, and the G. W. That the zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and general welfare of the com- munity. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide -3- adequate light and air; to prevent overcrowding of land, to avoid undue concentration of population; to facilitate the adequate provi- sions of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing, with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the parti- cular uses and with a view of conserving the value of building and encouraging the most appropriate use of land throughout the community. SECTION 3. That this ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of such ordinances, except in those instances where provi- sions of such ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. That all rights or remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of Ordinance No. 3011 or of any amendments thereto of said City of Fort Worth, Texas, that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations, and all pending litigation, both civil and criminal, same shall not be affected by this ordinance but may be pro- secuted until final disposition by the courts. SECTION 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or sec- tion of this ordinance shall be declared void, ineffective or uncon- stitutional by the valid judgment or decree of any court of competent jurisdiction, such voidness, ineffectiveness o.r unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City .Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sen- tence, paragraph or section. SECTION 6. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Thousand Dollars ($1,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 7. That the City Secretary of the City of Fort Worth, Texas, is hereby directed to engross and enroll this ordinance by copying the caption and penalty clause of same in the minutes of the City Council of the City of Fort Worth, Texas, and by filing the ordinance in the ordi- nance records of said City. SECTION 8. That the City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption, penalty clause and effective date of this ordinance for five (5) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Article 1176b-1, Revised Civil.
