AN ORDINANCE AMENDING ORDINANCE N0. 8219, THE FORT WORTH
BUILDING CODE, ALLOWING CERTAIN MODIFICATIONS TO PRIVATE
CORRIDORS WITH SPRINKLER SYSTEMS; DEFINING PUBLIC AND PRI-
VATE CORRIDORS; EXCEPTING PUBLIC AND PRIVATE CORRIDORS
WITH AUTOMATIC EXTINGUISHING SYSTEMS FROM CERTAIN FIRE
RESISTIVE CONSTRUCTION REQUIREMENTS; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING FOR A PENALTY, PROVIDING FOR PUBLICA-
TION; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
Ordinance No. 8219, the Building Code of the City of Fort
Worth, is hereby amended by revising Section 1807, Subsection (m),
Paragraph 2, thereof to read as follows:
"2. Except for public corridors in Group B, Divi-
sion 2 and Group R, Division 1 Occupancies and partitions
separating dwelling units or guest rooms, all interior
nonbearing partitions required to be one-hour fire-
resistive construction by Table No. 17-A may be of noncom-
bustible construction without a fire-resistive time
period."
SECTION 2,
Ordinance No. 8219 is hereby amended by adding the following
definitions to the definitions contained in Section 3301, Subsec-
tion (c) thereof:
"CORRIDOR, PUBLIC is an enclosed exit way protected
as required by Section 3304 (g) and (h). A public corridor
shall be required for any exit used by two or more ten-
ants on a floor of a building.
"CORRIDOR, PRIVATE is a corridor within a tenant
space which has exits leading to a public corridor or
exit. Private corridors shall meet the requirements of
Section 3304 (b), (c), (d), (e) and (f )."
SECTION 3.
Ordinance No. 8219 is hereby amended by adding the following
exceptions to the exceptions contained in Section 3304, Subsec-
tion (g) thereof:
"4. Except for Groups H, I and R-1 Occupancies, pub-
lic corridors shall not be required to be protected when
serving only one tenant and the entire floor is equipped
with an automatic extinguishing system. The sprinkler sys-
tem, when in operation, must sound local alarm systems and
place into operation the equipment necessary to prevent
the recycling of smoke.

"5. Except for Groups H, I and R-1 occupancies, corridors
shall not be required to be protected when the building is
of non-combustible construction and is entirely protected
by an automatic extinguishing system."
SECTION 4.
This ordinance shall be cumulative of all ordinances of the
City of Fort Worth except where the provisions of this ordinance are
in direct conflict with the provisions of such ordinances, in which
event conflicting provisions of such ordinances are hereby repealed.
SECTION 5.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such un-
constitutional phrase, clause, sentence, paragraph or section.
SECTION 6.
All rights or remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of Ordinance No. 8219
of the City of Fort Worth, Texas, and as to any other ordinance
affecting building standards, which have occurred at the time of the
effective date of this ordinance; and, as to such accrued violations
and all pending litigation, both civil and criminal, whether pending
in court or not, under such ordinances, same shall not be affected
by this ordinance but may be prosecuted until final disposition by
the courts.

SECTION 7.
The violation of any provision of this ordinance or of the Fort
Worth City Code shall be deemed an offense and shall be punishable
by a fine not exceeding Two Hundred Dollars ($200), and each viola-
tion hereof, and each day on which there is a failure to comply with
the terms of this ordinance, shall be and is hereby declared to be a
separate and distinct offense and punishable as such.
SECTION 8.
The City Secretary of the City of Fort Worth is hereby autho-
rized to publish the text of the "Fort Worth Building Code," as
hereby amended, in pamphlet form for general distribution among the
interested public, and such provisions of this ordinance as so pub-
lished shall be admissible in evidence in all courts without further
proof than the production of said pamphlet, as provided in
Chapter XXV, Section 3 of the Charter of the City of Fort Worth,
Texas.
SECTION 9.
The City Secretary of the City of Fort Worth, Texas, is hereby
directed to publish the caption, penalty clause and effective date
of this ordinance for five (5) days in the official newspaper of the
City of Fort Worth, as authorized by TEX. REV. CIV. STATS.,.
Art. 1176b-1.
SECTION 10.
This ordinance shall be in full force and effect from and
after the date of its passage and publication as above specified.

The Buildi~r~g Code Board of Appeals, on February 10, 1983, approved proposed
amendments on Section 1807, Section 3301(c), 3304 (a) and 3304 (g) of the City of

---- In summary, the proposals are as follows
1 When a sprinkler system is installed, sprinkling the entire building,
regardless of the number of occupants, corridor protection will not be
required
2 When a single floor is sprinkled and that floor contains only one tenant,
corridor protection will not be required
Items 1 and 2 above have been reviewed by the Building Code Board of Appeals,
'~ the Building Code Sub-Committee of the North Central Texas Council of Governments
and by the Building Officials in the International Council of Building Officials

~ in the metroplex area The above proposal is in line with both organizations'
"~ recommendations The original Code Coordination Committee of the Council of
~ ~ Governments will be hearing the Code Sub-Committee recommendations and it is
~` anticipated that the regular Code Coordination Committee will approve the

~' ~ The current Code adopted in 1981 deleted a local amendment that permitted non-

~' there have been a great number of Board cases appealing the corridor protection
~ requirement The number of cases has caused the Board, in its review of the 1982
~~ Uniform Building Code, to reconsider its previous actions Corridor protection
has also been a problem for other cities within the North Central Texas region
As a result of these problems, the Building Code Board of Appeals is recommending
these proposed amendments at this time, prior to adoption of the 1982 Code
Recommendation y
It is recommended, by the Building Code Board of Appeals, that~c~~
