BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: {= SECTION 1. " (a )' I n addition to other connection charges provided in this chapter, a front footage charge shall be paid for all service connections, made from and after the effective date hereof to all „water mains constructed or purchased after October 1, 1961, except connections to on-site mains for which the City has previously received~ypayment from a developer and except for reconnection ofAsingle customers to a water mains enlarged to provide adequate water service. ; ~: c. ;,~, ~ a "(b) In addition to other connection_ charges provided in this chapter, ,a front `footage charge shall be paid for gall sewer connections made from and after the effective date hereof ~to sanitary sewers authorized for construction after October l,. 1964, except ,service connections to sanitary sewers for which the City has previously received payment from a developer. .' , r ~ ~ t = ~ f s "(c) The following definitions shall be used in interpreting this section: .3 ~ ~' " (1) Single customer., An existing occupied residential establishment or an existing commercial establishment. r. ~ r` " (2) Developer. Any ..type of _ new customer other tha n a 'single customer'. "(3) Commercial establishment. Any establishment other than a one or two-unit residence. "(4) Front footage. The number of linear feet in that portion of a property boundary abutting a street, alley or easement containing a sanitary sewer or water main for which front footage charges are collected for connection. .H . ,. - ~. "~ .. SECTION 2. That this ordinance shall repeal every prior ordinance and provision of the Fort Worth City Code in conflict herewith but only insofar as any portion of such prior ordinance or provision shall be in conflict, and as to all other ordinances or provisions of the Fort Worth City Code not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 3 That the City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 4 It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5 That this ordinance shall be in full force and effect from and after the date of its passage, and it is so ordained. The next revision is to be effective July 12, 1983. These ,. new charges will be equal to 8'07' of the on-site front foot costs for water and sanitary sewers constructed under private or developer contracts let June 1, ~• 1982, through May 31, 1983. On this basis, the Community Facilities Policy should be amended to provide water and sewer extension charges for facilities constructed by City forces as follows: .. It is necessary to provide for an orderly transition from the old front foot and extension charges to the new charges, to take effect July 12, 1983. An ordinance be adopXed, effective July 12, 1983, amending Section 37-2b.1 of Chapter 37 of the Fart Worth City Code to decrease front foot charges for water service connections from $10.90 per front foot to $9.60 per front foot and to increase front foot charges for sanitary sewer service connections from $9.40 per front foot to $9.90 per front foot; and 2. The Water and Sanitary Sewer installation Policy be amended to incorporate these front foot charges and decrease the charge per foot of extensions constructed by City forces from $21.80 per foot to $19.20 per foot for water facilities and to increase the charge of $18.80 per foot for sanitary sewer facilities to $19.80 per foot, :and 3. Such charges shall become effective July 12, 1983, and shall apply to all developer projects on which bids have not been opened by that date and to all Ci.~y forces extension projects not authorized for construction by that dates N. .~ _.
