KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF TARRANT
This lease agreement made and entered into by and between the
Fort Worth Independent School District, hereinafter referred to as
"District", acting herein by and through its duly authorized Presi-
dent of the Board of Education, Dr. H. Richard O'Neal, and the City
of Fort Worth, a municipal corporation, hereinafter referred to as
"City", acting herein by and through its duly authorized Assistant
City Manager, David A. Ivory.
W I T N E S S E T H:
District hereby leases to City the building known as the Old
Thomas Place School building, located at 415U Lafayette Street in
the City of Fort Worth, Tarrant County, Texas, said lease site being
more specifically described and illustrated on Exhibit "A" attached
hereto and made a part hereof for all purposes.
This lease agreement shall be subject to the following terms
and conditions.
1.
This lease agreement shall be for a term of five (5) years be-
ginning on the 1st day of February, 1985, and ending on the 31st day
of January, 199U. City shall have the option to renew this lease
for an additional five (5) year term upon the same terms and condi-
tions as herein stated except that annual rental amount shall be
mutually agreed to by the parties hereto at the time of renewal.
City shall give notice of its intent to exercise such option to
renew, if at all, at least ninety (90) days prior to the end of the
initial term hereof. Failure to timely give said notice shall, at
the District's option, cause this lease to terminate at the end of
its initial term.

For and in consideration of the right to use and occupy the
demised premises, City agrees to pay District an annual rental

amount not to exceed the sum of Three Thousand Six Hundred and No/
LOU Dollars (43,600.00), or a total rental amount of Eighteen Thous-
and and No/lUU Dollars ($18,000.00) for the initial term. Said
total rental amount shall be paid in installments as follows: Two
Thousand Four Hundred and No/100 Dollars ($2,400.00) shall be due
and payable on or before the first day of February, 1985 for the
period February 1, 1985 through September 30, 1985; Three Thousand
Six Hundred and No/100 Dollars (43,600.00) shall be due and payable
on or before the first day of October, 1985, 1986, 1987, and 1988
for the periods October 1, 1985, 1986, 1987, and 1988 through
September 30, 1986, 1987, 1988 and 1989 respectively; and One Thous-
and Two Hundred and No/100 Dollars (41,20O.UO) shall be due and pay-
able on or before the first day of October, 1989 for the period
October 1, 1989 through January 31, 1990.

City shall use the demised premises solely for the purpose of
public recreation and for no other purpose.
4.
City shall be required to obtain the formal written approval of
District to make major improvements to the demised premises. Major
improvements shall include, but not exclusively: addition of rooms,
and/or removing main walls. City shall not be required to obtain
the formal written approval of District to make minor improvements
to the demised premises. Minor improvements shall include, but not
exclusively: removal of non-loadbearing partitions, removal or addi-
tion of carpeting, painting, addition of lighting, addition of cabi-
net space and/or addition of a small kitchen.
5.
City hereby agrees to pay all costs of maintenance and utili-
ties for the demised premises. City shall be responsible for any
damage which may occur to the demised premises as a result of fire,
windstorm, hail and water, and during the term hereof City shall
provide and keep in force adequate insurance coverage for such
hazards.

6.
City agrees to properly maintain the demised premises, together
with all furniture, fixtures and equipment located therein and to
suffer no waste. Upon termination of the lease agreement, City
shall deliver up the demised premises in good order and condition,
normal wear and tear excepted.
7.
This agreement may be cancelled by either party upon thirty
(30) days written notice of such intent to cancel.
8.
It is understood and agreed that District is not involved as a
party to any activities that may be carried on by City on the
demised premises. City agrees to hold District harmless from any
and all claims for personal injury or damage or loss of property
that might be incurred by City as a result of such activities.
9.
Neither party hereto shall assign or sublease its privileges,
rights or duties hereunder without the written permission of the
other party.

At its meeting on December 12, 1979 (MSC C-4926), the City Council authorized
City Secretary Contract No. 11113 leasing Thomas Place Recreation Center from
the Fort Worth Independent School District. The lease was for five (5) years
at a rental of $3,600 per year. Either party could cancel on thirty (30) days
notice.
The building, formerly known as the old Thomas Place School, is located at
4237 Lafayette. It is a popular recreation center serving a population in
excess of 24,000 in a nine square mile area which would not be otherwise
served by a recreation or multi-purpose center. This program is in response to
citizen input at CIP meetings, at Open Space Master Plan meetings, and from
the Arlington Heights Neighborhood Association.
The Fort Worth Independent School District has agreed to lease the recreation
center to the City for an additional five years, subject to the same terms,
conditions and rental as the present lease.
Recommendation
It is recommended that the City Council authorize the City Manager to execute
a lease agreement with the Fort Worth Independent School District extending
the City's lease of Thomas Place Recreation Center for five (5) years at
$3,600 per year.
