KNOW ALL MEN BY THESE PRESENTS:

This lease agreement made and entered into by and between the
Fort Worth Independent School District, hereinafter referred to as
"District," acting herein by and through its duly authorized President
of the Board of Education, Dr. Richard O'Neal and the City of Fort
Worth, a municipal corporation, hereinafter referred to as "City,"
acting herein by and through its duly authorized City Manager, Robert
L. Herchert.
W I T N E S S E T H
District hereby leases to City the Building known as the Old
Thomas Place School building, located at 4150 Lafayette Street in
the City of Fort Worth, Tarrant County, Texas, said lease site being
more specifically described and illustrated on Exhibit "A" attached
hereto and made a part hereof for all purposes.
This lease agreement shall be subject to the following terms
and conditions.
1.
This lease agreement shall be for a term of five (5) years
beginning on the lst day of February, 1980, and ending on the 31st
day of January, 1985. City shall have the option to renew this
lease for an additional five (5) year term upon the same terms and
conditions as herein stated except that annual rental amount shall
be mutually agreed to by the parties hereto at the time of renewal.
City shall give notice of its intent to exercise such option to renew,
if at all, at least 90 days prior to the end of the initial term
hereof. Failure to timely give said notice shall, at District's
option, cause this lease to terminate at the end of its initial term.
2.
For and in consideration of the right to use and occupy the
demised premises, City agrees to pay District an annual rental amount
not to exceed the sum of Three Thousand Six Hundred and No/100 Dollars
($3,600.00), or a total renta' amount of Eighteen Thousand and No/100
Dollars
($18,000.00) for the initial term. Said total rental amount

shall be paid in installments as follows: Two Thousand Four Hundred
and No/100 Dollars ($2,400.00) shall be due and payable on or before
the first day of February, 1980 for the period February 1, 1980
through September 30, 1980; Three Thousand Six Hundred and No/100
Dollars ($3,600.00) shall be due and payable on or before the first
day of October, 1980, 1981, 1982 and 1983 for the periods October 1,
1980, 1981, 1982 and 1983 through September 30, 1981, 1982, 1983
and 1984 respectively; and One Thousand Two Hundred and No/100
Dollars ($1,200.00) shall be due and payable on or before the first
day of October 1984 for the period October 1, 1984 through January
31, 1985.
3.
City shall use the demised premises solely for the purpose of
public recreation and for no other purpose.
4.
City shall be required to obtain the formal written approval of
District to make major improvements to the demised premises. Major
improvements shall include, but not exclusively; addition of rooms,
and/or removing main walls. City shall not be required to obtain the
formal written approval of District to make minor improvements to
the demised premises. Minor improvements shall include, but not
exclusively; removal of non-loadbearing partitions, removal or
addition of carpeting, painting, addition of lighting, addition of
cabinet space and/or addition of a small kitchen.
5.
City hereby agrees to pay all costs of maintenance and utilities
for the demised premises. City shall be responsible for any damage
which may occur to the demised premises as a result of fire, windstorm,
hail and water, and during the term hereof City shall provide and
keep in force adequate insurance coverage for such hazards.
6.
City agrees to properly maintain the demised premises, together
with all furniture, fixtures and equipment located therein and to
suffer no waste. Upon termination of the lease agreement, City
shall deliver up the demised premises in good order and condition,

normal wear and tear excepted.
7.
This agreement may be cancelled by either party upon thirty (30)
days written notice of such intent to cancel.
8.
It is understood and agreed that District is not involved as a
party to any activities that may be carried on by City on the demised
premises. City agrees to hold District harmless from any and all
claims for personal injury or damage or loss of property that might
be incurred by City as a result of such activities.
9.
Neither party hereto shall assign or sublease its privileges,
rights or duties hereunder without the written permission of the
other party.

Background
The proposed Thomas Place Recreation Center would serve a nine square mile
area of Arlington Heights with a population in excess of 24,000 which is
presently not served with either a recreation center or multi-purpose center.
Citizen input at the Open Space Master Plan meetings, the 1978 CIP meetings,
and more recent input from the Arlington Heights Neighborhood Association
indicates that there is a demand for such a facility in this area of the
community.
The proposed recreation center would be achieved through the lease of the Old
Thomas Plance School from the Fort Worth Independent School District and its
conversion to a facility which will accommodate activities such as arts,
crafts, music, dancing, gymnastics, exercise, various table games and senior
citizen programs.
The budget below outline- costs for the remainder of the 1979-80 budget year
and an estimated budget that would be required for the annual operation of
the Center.

Recommendations
It is recommended that the City Council:
1. Adopt a supplemental appropriation ordinance appropriating $53,350
from the fund balance of the General Fund to Account No. 80-30-60
for the purpose of providing a recreation center at the Old Thomas
Place School, this amount will provide funding for the periof of
March through September,1980;

20 Authorize the City Manager to execute a lease agreement with the
Fort W—th Independent School District to lease the Old Thomas
Place School for five years with a five-year extension option
at an annual lease rate of $3,600 for the first five years;
3. Authorize the Citv Manager to amend the existing Thomas Place
School Site Lease Agreement with the Fort Worth Independent
School District to include provisions which would permit the City
to construct a parking area on the Thomas Place Site; and
4. Approve the following bond fund transfer to pay for parking lot
facilities at the Thomas Place Park Site.
