STORMWATER FACILITY
MAINTENANCE AGREEMENT
THIS AGREEMENT, made and entered into this day of
4k , by and between Halle Properties, LLC, hereinafter referred to as "Landowner",
and the City of Fort Worth, hereinafter referred to as "City".
WITNESSETH
WHEREAS, the Landowner is the owner of certain real property described as an
approximately 1.384 acre tract located in the M.E.P. and P.R.R. Survey, Abstract 1131,
Tarrant County, Texas according to the deed recorded in Instrument D207294400, Official
Public Records, Tarrant County, Texas, hereinafter called the "Property".
WHEREAS, the Landowner is proceeding to build on and develop the Property
according to the Site Plan/Subdivision Plan known as Lot 11, Block 1, Vista Crossroads
Addition hereinafter called the "Plan', which is expressly made a part hereof, as approved
or to be approved by the City and the Landowner provides for management of Stormwater
within the confines of the Property; and
WHEREAS, the City and the Landowner, and their successors and assigns, agree
that the health, safety and welfare of the residents of the City of Fort Worth, Texas require
9 that on-site Stormwater Management Facilities be constructed and maintained on a portion
of the Property; and

WHEREAS, the City requires that on-site Stormwater Management Facilities
("Facility") as shown on the Plan be constructed and adequately maintained by the
Landowner, its successors and assigns, the location and dimensions of which is shown and

more particularly described by metes and bounds in the attached Exhibit "A" ("Facility
Property"); and
NOW, THEREFORE, in consideration of the foregoing premises, the mutual
covenants contained herein, and the following terms and conditions, the parties hereto
agree as follows:
1. The Landowner, its successors and assigns, shall adequately construct and
maintain the on-site Stormwater Management Facility ("Facility") at no
expense to the City of Fort Worth in accordance with the design specifications
for the Facility, attached as Exhibit "B", and the current standards then in force
and effect in the City of Fort Worth and with the Operations and Maintenance
Plan attached to this Agreement as Exhibit "C". The Stormwater Facility
includes all pipes, channels or other conveyances built to convey Stormwater
to the facility, as well as all structures, improvements, and vegetation provided
to control the quantity and quality of the Stormwater. Adequate maintenance is
herein defined as good working condition so that these facilities are performing
their design functions. The Stormwater Structural Control Maintenance
Checklists, attached to this Agreement as Exhibit "D", are to be used to
establish what good working condition is acceptable to the City.
2. The Landowner, its successors and assigns, shall inspect the Facility and
submit an inspection report to the City annually. The purpose of the inspection
is to assure safe and proper functioning of the Facility. The inspection shall
cover the entire Facility, berms, outlet structure, pond areas, access roads, etc.
Components of the Facility, which need maintenance or replacement to
perform their design function, shall be noted in the inspection report along with
the corrective actions to be taken.
3. The Landowner, its successors and assigns, hereby grant permission to the
City, its authorized agents and employees, to enter upon the Property and to
inspect the Facility Property whenever the City deems necessary. The purpose
of inspection is to follow-up on reported deficiencies and/or to respond to

citizen complaints. The City shall provide the Landowner, its successors and
assigns, copies of the inspection findings and a directive to commence with the
repairs if necessary.
4. In the event the Landowner, its successors and assigns, fails to maintain the
Facility in good working condition as specified herein, the City, its authorized
agents and employees, may enter upon the Facility Property and take whatever
steps necessary to correct deficiencies identified in the inspection report and to
charge the costs of such repairs to the Landowner, its successors and assigns.
It is expressly understood and agreed that the City is under no obligation
to routinely maintain or repair said Facility, and in no event shall this
Agreement be construed to impose any such obligation on the City, such
obligation is Landowner's.
5. The Landowner, its successors and assigns, will perform the work necessary to
keep the Facility in good working order as appropriate. In the event the City
pursuant to this Agreement, performs work of any nature, or expends any funds
in performance of said work for labor, use of equipment, supplies, materials,
and the like, the Landowner, its successors and assigns, shall reimburse the
City upon demand, within thirty (30) days of receipt thereof for all actual costs
incurred by the City hereunder. In the event that Landowner or its successors
or assigns fail to pay the City for the costs incurred under this section, the City
shall impress a lien for the costs of such work upon other lots owned by the
Landowner. Such lien shall be perfected by filing in the office of the County
Clerk of Tarrant County, Texas an affidavit identifying the property to be
charged with such lien, stating the amount thereof, and making reference to
this Agreement.
6. This Agreement imposes no liability of any kind whatsoever on the City. THE
LANDOWNER AGREES TO HOLD THE CITY HARMLESS FROM
ANY LIABILITY IN THE EVENT THE FACILITY FAILS TO
OPERATE PROPERLY. LANDOWNER COVENANT AND AGREE
AND DOES HEREBY INDEMNIFY, HOLD HARMLESS AND DEFEND
THE CITY OF FORT WORTH, ITS AGENTS, SERVANTS AND
STORMWATER FACILITY MAINTENANCE AGREEMENT 3

EMPLOYEES FROM AND AGAINST ALL COSTS, EXPENSES,
LOSSES, DAMAGES, CLAIMS OR CAUSES OF ACTION
WHATSOEVER ARISING, OR WHICH MIGHT ARISE, FROM THE
FAILURE OF LANDOWNER OR ANY FUTURE OWNERS OF THE
ABOVE FACILITITY PROPERTY TO MAINTAIN THE FACILITY,
INCLUDING, BUT NOT LIMITED TO THE BED AND BANKS OF
THE DETENTION POND; ANY DAMAGES CAUSED TO PERSON OR
PROPERTY DUE TO (1) FLOODING OF THE POND AND ITS
BANKS, (2) SLOPE FAILURE OF THE BANKS OF THE POND, OR (3)
FAILURE OF THE POND OR ITS BANKS TO OPERATE IN A
MANNER CONSISTENT WITH CITY OF FORT WORTH CRITERIA
TO PERFORM ANY OTHER DUTIES OR OBLIGATIONS
HEREUNDER.
7. Landowner covenants and agrees that no habitable building shall be erected
within the drainage easement outlined on Exhibit "A" but this paragraph shall
not preclude construction of other improvements within the drainage easement,
which do not impede drainage. Landowner covenants and agrees that no
habitable building shall be erected on the above property abutting such
easement which shall have a finished floor at an elevation less than two feet
above the maximum depth of water in the detention pond which would occur
during a 100 year frequency flood.
8. This Agreement shall be recorded among the land records of Tarrant County,
Texas, shall constitute a covenant running with the land, and shall be binding
on the Landowner, its administrators, executors, assigns, heirs and any other
successors in interests, including any property owners association.

BASELINE DATA COLLECTION AND ANALYSIS
The site is proposed to be developed as a Discount Tire Store (DTS) on a 1.38-acre proposed
Lot 11, Block 1 of the Vista Crossroads Addition in Fort Worth, Texas. It is generally located
1700 feet southeast of the intersection of U.S. Highway 287 (U.S. 81) and Avondale-Haslet
Road on the northern side of the northbound service road of U.S. 287. The developer proposes
to construct a commercial building with associated parking areas, detention pond and a crossing
of a road side channel.
The development of an on-site detention pond is the selected method for the flood mitigation
option. This is per Option 2 provided in Section 3.7.2 of the City of Fort Worth Stormwater
Criteria Manual. Two other iSWM plans are under development by others for the site area
including: 1)the Vista Crossroads Addition improvements (for the entire subdivision) by Teague
Nall & Perkins, and, 2)the Taco Bell development being prepared by Dunaway. The proposed
Taco Bell site is located northwest and adjacent to the DTS in Lot 10 of the Vista Roads
Addition.
The following information is for the proposed Discount Tire site.
Topography
Existing topography is relatively flat grassland sloping approximately 1% from north to south.
Existing contour data was surveyed by Peiser& Mankin Surveying, LLC and can be viewed on
the design plans.
Drainage Patterns and Basins
The site is in the Indian Creek— Eagle Mountain Lake watershed that drains to Eagle Mountain
Lake with the receiving waters being the Upper West Fork of the Trinity River. The local
drainage pattern is from north to south where storm water flow enters a 36" rcp through an
existing headwall. Storm water is conveyed northeasterly in a series of pipes under the
northbound service road.
The design of this storm water system was prepared by Halff Associates as part of the US
287/81 roadway plans. The TXDOT plans were prepared under Control No. 1600, Secion 15,
Job No. 032.
The proposed development of the Taco Bell by Dunaway includes construction of an open
conveyance channel along the southerly side of the DTS site along with an inlet and connection
pipe to the existing 36" rcp in the service lane. The Taco Bell development will include a
detention pond and outlet that flows into the open channel.
There are no intermittent or perennial streams on-site.
Soil Types
Soil types in the upper limits of the site are CH clay to approximately two feet deep where
limestone layers intermixed with clays can be found. The soils are considered erosive and will
be maintained through cover vegetation on the soils and by pavement and structures that offer
more permanent solutions.
Ground Cover and Vegetation
The ground is covered with native grasses. There are no particularly unique or sensitive
vegetation areas to be protected during development.
Existing development
The site is currently undeveloped. There is a retail development anchored by a Walmart store
approximately 120 feet north and west of the site. Undeveloped, agricultural land is located
east, south, and west of the site across U.S. 287.
Existing Storm Water Facilities
There are no existing storm water facilities on-site. However, an earthen channel will be
constructed across the south side of the site as part of the development of a new Taco Bell
restaurant immediately northwest of the site. The Taco Bell has been proposed on Lot 10,
Block 1 of the Vista Crossroads Addition. Off-site storm water facilities that will receive
discharges from the proposed development include the open channel and an existing reinforced
concrete pipe parallel to the site boundary along U.S. 287.
Property Lines
The site property lines, adjacent owners and local easements are show on the proposed plans.
This data is based on surveys prepared by Peiser& Mankin Surveying, LLC described in the
plans.
Wetlands and Critical Habitat Areas
There are no know wetlands, Waters of the United States, or critical habitat areas located on the
site.
Wooded Areas
There are no wooded areas or trees clusters located on the site.
Floodplain Boundaries
There are no regulatory floodplain boundaries located within the site. The site and surrounding
area can be reviewed on FEMA FIRM panel number 48439C0035K dated September 25, 20019.
Steep Slopes
There are no steep slopes located on the site.
Buffers and Setbacks
There are no required buffers or setbacks along any water bodies.
Stream Crossings
There are no proposed stream crossings. The proposed conveyance channel along the service
road of S.H. 187 will be crossed by a sidewalk as part of the Discount Tire Store detention pond
development.
There are no other know required protection areas.
Site Plan
The Site Plan is provided in the plans and is labeled SP1.
Pre-development Aerial Photo with Composite Impervious Area Calculations
Sheet C3.0 of the design plans includes the pre-development plan for the watershed sub-basin
with an aerial photograph and calculations.
Drainage Area Map
Sheets C3.1 provides the site drainage area maps and calculations for the pre-developed and
post-developed conditions.
Simplified Methods Utilized and Documentation Provided
The development of an on-site detention pond is the selected method for the flood
mitigation option. This is per Option 2 provided in Section 3.7.2 of the City of Fort Worth
Stormwater Criteria Manual. The detention calculations are provided on sheet 3.2 of the
design plans.
The detention pond was calculated using the Modified Rational Method described in
Section 1.5 of the Hydrology Manual. The spreadsheets provided on sheet 3.2 are the
non-iterative spreadsheet calculations developed by Debo & Reese in 2003.
Detention pond volumes along with the Orifice Calculations for the outlet structure are
provided for the 1, 10, and 100-year storms on sheet C3.2. The Outlet Structure Detail
is provided on sheet 3.1.
Storm water flows to an existing system designed by Halff Associates as part of the highway
design. The detention calculations include the pass-through of the Taco Bell site per the
Dunaway design and the information is provided on sheet 3.2 of the design plans.
A schematic plan of the detention basin is provided on the following page. The proposed
Landscape plans are provided on the following pages along with selected site design plans.

CITY OF FORT WORTH STORMWATER FACILITY
OPERATION AND MAINTENANCE PLAN
The only responsibility the City of Fort Worth has in the operation and
maintenance of this Facility is inspection.
General Maintenance Procedures
The structural and functional integrity of the Facility shall be maintained at all
times by removing and preventing drainage interference, obstructions, blockages,
or other adverse effects into, through, or out of the system.
Periodic silt removal shall occur when standing water conditions occur or the
pond's storage volume is reduced by more than 10%. Silt shall be removed and
the pond/basin returned to original lines and grades shown on the approved
engineering plans. In addition, corrective measures are required any time a basin
does not drain completely within 72 hours of cessation of inflow. NO STANDING
WATER IS ALLOWED in basins designed for dry detention purposes.
Accumulated litter, sediment, and debris shall be removed every 6 months or as
necessary to maintain proper operation of the basin. Disposal shall be in
accordance with federal, state and local regulations.
Detention facilities shall be mowed monthly between the months of April and
October or anytime vegetation exceeds 12-inches in height.
To prevent debris from entering and clogging the downstream storm sewer
system a wire mesh screen or similar screening device shall be installed over the
outlet until final acceptance.
4. PREVENTIVE MAINTENANCE/INSPECTION
• Visual inspections of all components will be conducted every 6 months.
• A log shall be kept of maintenance actions, and inspections. The log
should document the condition of the detention system's primary
components, mowing, and silt, litter and debris removal dates. Document
aeration of the basin bottoms and replanting to prevent the sealing of the
basin bottom.
• Written maintenance and repair records shall be maintained by the
party or parties signing the attached Agreement and shall be provided
to the City upon request.

INTRODUCTION
This Operation and Maintenance Manual is produced specifically for the 1.4 acre
Discount Tire Company site located at proposed Lot 11, Block 1, Vista Crossroads
Addition in the city of Fort Worth, Texas. Please note that this manual and its associated
inspection records are to be kept on-site.
While maintaining the Detention Pond, safety considerations shall be at the forefront of
inspection procedures at all times. Likely hazards should be anticipated and avoided.
Never enter an outlet structure without proper training or equipment. A confined space
entry should never be entered without at least one additional person present.
Vertical drops may be encountered in areas located within and around the facility.
Avoid walking on top of retaining walls or other structures that have a significant vertical
drop. Be familiar with the surroundings. When the landscaping shows signs of saturated
soils and standing water, limit the access of equipment that can be a hazard.
1. ROUTINE MAINTENANCE SPECIFICATIONS
To ensure that the Detention Pond is being properly maintained, routine maintenance will
be performed on a frequent basis. This is expected to help avoid more costly
rehabilitative maintenance that results when ponds are not adequately maintained.
At a minimum the following maintenance items shall be addressed:
A. Mowing: To be performed at least twice a month.
B. Outlet Structure: To be inspected quarterly. Any debris found in or around the
structure to be removed and legally disposed of Silt that may settle within the
outlet structure or at the entry of the through-pipes shall be removed and the area
reseeded as required.
C. Rip-Rap: Grass/weeds to be removed at least twice a month with mowing
operations.
D. Debris Pick-up: To be performed at least twice a month with mowing operations.
2. NON-ROUTINE MAINTENANCE SPECIFICATIONS
Non-routine items that may require attention include the following:
A. Bank Repair and Stabilization: To be performed quarterly. Side slopes and top of
banks shall be examined quarterly for sloughing or erosion of the soils. Areas
requiring attention shall be regraded, compacted and reseeded or sodded to
provide appropriate grass cover.
B. Re-vegetation: To be inspected quarterly. Area where vegetation has eroded or
died shall be regraded, compacted and reseeded or sodded to provide appropriate
grass cover.
C. Sediment Removal: To be inspected quarterly. Sediment shall be removed from
the pond if it reaches a depth of 5" above bottom grade. The sediment shall be
removed, the area will be regraded, and be reseeded or sodded to provide
appropriate grass cover.
D. Structural Repair: To be inspected quarterly. The outlet structure, the rock rip rap
structures, and the sloped headwalls shall be inspected for cracks, failure, or
sloughing. They shall be repaired as required to perform as designed.
E. Mechanical Equipment Repairs: There is no mechanical equipment as part of the
detention basin.
See Exhibit B for a drawing showing the locations of the above mentioned maintenance
items.
Written maintenance and repair records shall be maintained by the Owner and shall be
provided to the City upon their request. Inspection forms shall be completed whenever
maintenance procedures are performed on the detention pond. Inspection forms can be
found in Exhibit D.
