Charles W. Tindall, Trustee, owner of all abutting property, has requested that
the City vacate the following:
(1) The 26' wide emergency access and utility easement in Blocks 6 and 6R, South-
land Terrace Addition, from IH 35W South, east to Evans Avenue, and,
(2) The 20' x 20' Public Open Space Easements at the four intersecting corners
of the 26' Emergency Access and Utility Easement; IH 35W South and Evans
Avenue; all as shown. on the plat recorded in Volume 388-125, page 26,
P.R.T.C.T., and also as shown on the attached map
The subject (emergency access and utility and public open space) easements,
acquired by dedication (during the replatting of Block 6-R, Southland Terrace
Addition), are platted, contain no utility facilities, are not being utilized
for emergency access and provide no traffic sight distance functions associated
with the use of the aforementioned 26' emergency access and utility easement
The subject vacation request is made in order to replat the vacated easements
with the abutting property, deleting all encumbrances on the subject property,
thus expanding the building area and providing more usable yard space
Reviewing City departments and private utility companies have raised no objections
to this request, provided the subject easements are replatted with the abutting
property. A satisfactory replat has been submitted
Recommendation
It is recommended that an Ordinance be adopted vacating the 26' wide emergency
access and utility easement and the four public open space easements in Blocks
6 and 6R, Southland Terrace Addition
