HomeMy WebLinkAboutOrdinance 22368-08-2016 ORDINANCE NO. 22368-08-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $1,050,000.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING SYCAMORE CREEK DRAINAGE BASIN PARALLEL INTERCEPTOR IMPROVEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of $1,050,000.00, from available funds, for the purpose of funding Sycamore Creek Drainage Basin Parallel Interceptor Improvements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Sewer Capital Projects Fund in the amount of$1,050,000.00 from available funds; and 2. Authorize execution of Amendment No. 2 to City Secretary Contract No. 45280, an Engineering Agreement with Lockwood, Andrews & Newnam, Inc., in the amount of$839,715.00 for Sycamore Creek Drainage Basin Parallel Interceptor Improvements at various locations.thereby increasing the contract amount to $1,583,854.00. .DISC USSION• On November 19, 2013, Mayor and Council Communication (M&C C-26567) City Council authorized an Engineering Agreement with Lockwood, Andrews & Newnam Inc., in the amount of$575,828.00 for the Sycamore Creek Drainage Basin Parallel Interceptor Improvements at various locations within the Sycamore Creek Drainage Basin. The Agreement was subsequently revised by Amendment No.1 (M&C C-26964) September 9, 2014 in the amount of$168,311.00. Amendment No. 2 will provide for the design of a 66/54-inch sanitary sewer interceptor beginning at a sanitary sewer junction structure north of IH-30 and east of Riverside Drive and end at the Vickery Boulevard/Sycamore Terrace intersection. The proposed scope of work includes the following: • Crossings of the Interstate Highway 30, Lancaster Avenue and Union Pacific Railroad right-of-way • Junction structures and system interconnections of existing sanitary sewer mains • Environmental Assessment • Coordination with other agencies • Geotechnical investigation • Easement preparation • Subsurface utility engineering Lockwood, Andrews & Newnam, Inc., proposes to perform the necessary additional work for a lump sum fee of$839,715.00. Staff considers this fee to be fair and reasonable for the scope of services proposed. Logname: 60SCM275VARA2 - LAN Page 1 of 3 In addition to the contract cost, $210,285.00 is required for project management, real property acquisitions, utility coordination and material testing. Engineering for the Sycamore Creek Drainage Basin Parallel Interceptor Improvement Project is one component of the overall project that includes project management, easement acquisition, utility coordination, material testing, inspection, construction and contingencies. The overall project budget is $15,833,139.00. This project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. This project will have no impact on the Water Department's operating budget when complete. Design for this project is expected to be complete by December 2018 with construction starting in May 2019 and construction being completed by April 2022. M/ BE OFFICE: Lockwood, Andrews & Newnam, Inc., agrees to maintain its initial SBE commitment of 20 percent that it made on the original Agreement and extend and maintain that same SBE commitment of 20 percent to all prior amendments up to and inclusive of this Amendment No. 2. Therefore Lockwood, Andrews & Newnam, Inc., remains in compliance with the City's BDE Ordinance and attests to its commitment by its signature on the Acceptance of Previous SBE Commitment form executed by an authorized representative of its company. The project is located n COUNCIL DISTRICT 8, Mapsco 77D and 77R. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance funds will be available in the current capital budget, as appropriated, of the Sewer Capital Projects Fund. The Fiscal Year 2016 water and sewer operating Budget includes appropriations of$26,300,046.00 for the purpose of providing Pay-As-You-Go funding for capital projects. After this transfer for Fiscal Year 2016, the balance for sewer capital projects will be $10,642,730.00.
