AN ORDINANCE AMENDING CHAPTER 2, ARTICLE V, SECTION 2-
35.2, "RULES FOR CERTAIN CITY BOARDS AND COMMISSIONS", OF
THE CODE OF THE CITY OF FORT WORTH, TO PROVIDE FOR THE
EXEMPTION BY THE CITY COUNCIL OF CERTAIN BOARDS FROM THE
LENGTH OF TERMS PROVISIONS OF THAT SECTION; ADDING THE
NEIGHBORHOOD RESOURCES DEVELOPMENT COUNCIL TO THE LIST OF
EXEMPTED BOARDS; PROVIDING A SEVERABILITY CLAUSE; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING
AN EFFECTIVE DATE; AND PROVIDING FOR ENGROSSMENT AND
ENROLLMENT OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1
That Section 2-35.2 of Article V of Chapter 2 of the Code of
the City of Fort Worth, Texas (1964), as amended, be, and is hereby
amended to read as follows:
"Sec. 2-35.2. Exceptions.
"Those boards excepted from the provisions of this
section regarding the number of members serving on the
board, and regarding the length of terms of service,
because of conflicting state law, city charter provision
or City Council exception shall include currently, but
shall not be limited to, the following:
Board of Adjustment
Civil Service Commission
Dallas-Fort Worth Regional Joint Airport Zoning Board
Meacham Field Joint Airport Zoning Board
Dallas-Fort Worth Regional Airport Board
Board of Commissioners of the Fort Worth Housing
Authority
Fort Worth Human Relations Commission
Personnel Commission
Board of Trustees of the Employees' Retirement Fund.
Neighborhood Resources Development Council
SECTION 2.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1964), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court. of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
The City Secretary of the City of Fort Worth, Texas, is hereby
authorized to publish this ordinance in pamphlet form for general
distribution among the public, and the operative provisions of this
ordinance as so published shall be admissible in evidence in all
courts without further proof than the production thereof, as pro-
vided in Chapter XXV, Section 3, of the Charter of the City of Fort
Worth, Texas.
SECTION 5.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
effective date in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 6.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Background
On March I5, 1983, the City Council approved amendment of Chapter 2, Article V
of the City Code regarding City boards and commissions. This amendment provided
that certain boards and commissions would be excepted from the rule that all
boards and commissions will have nine membership places. This exemption applies
to boards and commissions, whose size is governed by conflicting state law,
City Charter provision or City Council exception.
It has come to the attention of staff members that, in order to enhance the
efficient administration of certain of the boards and commissions which are
excepted from the provisions regarding the number of members, these boards and
commissions should also be excepted from the length of terms provisions of
Chapter 2, Article V, Section 2-35.2. That is, terms of longer than two years
should be allowed in certain instances.
It has also been noted that the Neighborhood Resources Development Council
should be added to those boards and commissions excepted under the terms of
Section 2-35.2.
Recommendation
It is recommended that the City Council approve the attached ordinance, amend-
ing Chapter 2, Article V, Section 2-35.2 of the City Code, to allow for the
exception of certain boards and commissions from the length of term provisions
of that Article, and adding the Neighborhood Resources Development Council to
those boards and commissions excepted under Section 2-35.2 of said Article.
