HomeMy WebLinkAboutContract 26350 CITY SECRETARY 11-06-00 A10 : 08 ► CONTRACT NO SUPPLEMENTAL ENVIRONMENTAL PROTECT AGREEMENT between CITY OF FORT WORTH and THE TEXAS NATURAL RESOURCE CONSERVATION COMMISSION Attachment "A" Supplement 1 The Supplemental Environmental Project Agreement between the City of Fort Worth and the Texas Natural Resource Conservation Commission ("TNRCC"), effective February 1, 1999, is hereby supplemented pursuant to paragraphs one (1) and eighteen (18) of that agreement such that: Attachment "A" is supplemented to include the project described herein. The city, in implementing this project approved after the date of the agreement by the Director of. the Litigation Division, is to be bound by the primary agreement and all the terms and conditions it contains. Project Title: Purchase of_EleMic Powered Lawn Mowers Description: The city will purchase electric powered lawn mowers to be used by the city's parks and recreation department instead of fuel powered lawn mowers. Benefit: Reduce air emissions that are generated by fuel powered lawn mowers which contribute to ozone problems in the Dallas-Fort Worth non-attainment area. Authorize the City Manager to execute a contract amendment to City Secretary Contract (No. 24660) with the Texas Natural Resource Conservation Commission (TNRCC) to include the use of Supplemental Environmental Project (SEP) funds for the purchase of electric lawn mowers; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by $800. DISCUSSION: On January 5, 1999 (M&C C-17212), the City Council approved an Interlocal Agreement with the TNRCC authorizing participation in the TNRCC's SEP Program. Under this agreement, the City is eligible to receive funds from various entities when those entities are assessed administrative penalties by the TNRCC. Entities that elect to participate in the SEP program may give up to 50% of assessed fines to an environmental cause in their local area. The TNRCC has indicated that the City will be receiving an $800 check as part of an agreed order with an unidentified entity. The Environmental Management Department will use this money exclusively for the purchase of additional electric lawn mowers for the City. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grants Fund.
