ORDINANCE NO. ~ ~ 7
AN ORDINANCE AMENDING CHAPTER 43, ARTICLE I (CODE OF
ETHICS) OF THE CODE OF THE CITY OF FORT WORTH (1964), AS
AMENDED, BY AMENDING THE DEFINITION OF THE TERM "OFFICER"
AS THAT TERM IS USED IN CHAPTER 43; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 43-1 (B)(2) of Article I of Chapter 43 of the Code
of the City of Fort Worth, be, and the same is hereby amended to
read as follows:
"Sec. 43-1.
(B) Definitions
(2) "Officer": Any member of the City Council and any
appointive member of a board, commission or committee
established by ordinance, charter or state law; provided,
no member of a board, commission or committee that func-
tions only in an advisory or study capacity shall be deem-
ed an officer of the City for purposes of this Code of
Ethics."
SECTION 2.
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth, Texas (1964),
as amended, except where the provisions of this ordinance are in
direct conflict with the provisions of such ordinance and such code,
in which event conflicting provisions of such ordinances and such
code are hereby repealed.

SECTION 3.
That it is hereby declared to be the intention of the City
Council of the City of Fort Worth, Texas, that the sections, para-
graphs, sentences, clauses and phrases of this ordinance are sever-
able and if any section, paragraph, sentence, clause or phrase of
this ordinance shall be declared void, ineffective or unconstitu-
tional by the valid judgment or final decree of a court of competent
jurisdiction, such voidness, ineffectiveness or unconstitutionality
shall not affect any of the remaining sections, paragraphs, sen-
tences, clauses or phrases of this ordinance since the same would
have been enacted by the City Council without the incorporation
herein of any such void, ineffective or unconstitutional section,
paragraph, sentence, clause or phrase.
SECTION 4.
This ordinance shall be in full force and effect from and after
the date of passage.

Background ~.
On November~l6, 1982, the City Council approved M&C G-5476, "Handbook for
Boards and Commissions: Changes in Rules for and Composition of Boards
and Commissions." One of the recommendations made therein was that the
Code of Ethics, Chapter 43, of the Code of the City of Fort Worth, be
amended to provide a more precise definition of the term "officer," as
that term is used in the Code of Ethics. The revised definition has been
incorporated in the attached ordinance and reads as follows:
"Officer Any member of the City Council and any appointive

ordinance, charter or state law, provided, no member of a
board, commission or committee that functions only in an
advisory or study capacity shall be deemed an officer of the
City for purposes of this Code of Ethics."
Recommendation
It is recommended that the City Council adopt the attached ordinance.,
amending Chapter 43 of the Code of the City of Fort Worth, revising the
definition of "officer" as used in Chapter 43.
