AN ORDINANCE VACATING, ABANDONING AND CLOSING THE 3900 BLOCK OF OLD BENBROOK ROAD AND A PORTION OF THE 7300 BLOCK OF KERMIT AVENUE, BOTH BEING PUBLIC STREET RIGHTS-OF-WAY; REPEALING PRIOR ORDINANCE NO. 8857 DEALING WITH SAID VACA- TION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL OTHER ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. WHEREAS, THE City Council of the City of Fort Worth, on June 28, 1983, adopted Ordinance No. 8857, vacating the 3900 block of Old Benbrook Road and a portion~~of the 7300 block of Kermit Avenue, both being public street rights-of-way and both being more particularly described within said ordinance; and WHEREAS, it has been determined that the property descriptions of the aforesaid vacated public streets, as contained in the afore- said Ordinance No. 8857, were inaccurate in describing the extent of the right-of-way to be vacated; and WHEREAS, it is the intent of the City Council to repeal said Ordinance No. 8857 and substitute therefor an ordinance containing a correct property description for the aforesaid public streets to be vacated; NOW, THEREFORE; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following be and the same are vacated, abandoned and permanently closed as public street rights-of-way: A. The 3900 block of Old Benbrook Road, a width of fifty (50) feet, from Kermit Avenue northward four hundred ten (410) feet to State Highway 377; and B. A twenty (20) foot wide portion of the 7300 block of Kermit Avenue, said portion being more particularly described by metes and bounds in Exhibit "A", attached hereto and incorporated as if set out in full herein. SECTION 2. That the fee to the lands in the above described vacated public street rights-of-way is hereby released and shall revert to the fi ,t ., A, ~ !~ F r t adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That Ordinance No. 8857, adopted by the City Council of th e City of Fort Worth on June 28, 1983, is hereby repealed. That all other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained.
