Q 7 AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING THE 4300 BLOCK OF IOLA STREET, A WIDTH OF 50 FEET, FROM WHITTLESEY ROAD SOUTH TO WILBARGER STREET, AND A PORTION OF THE 10 FOOT WIDE EAST/WEST UTILITY EASEMENT LOCATED ALONG THE COMMON PROPERTY LINE OF LOTS 10 AND 11, WILKES ESTATES ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE following be and the same are vacated, abandoned, and permanently closed and extinguished as a public street right-of-way and utility easement, respectively: A. The 4300 Block of Iola Street, a width of 50 feet, from Whittlesey Road south to Wilbarger Street; and B. The portion of the 10 foot easement located along and property line of Lots 10 Addition, from Iola Street point 5 feet west of the ea aforesaid Lots 10 and 11. wide east/west utility parallel to the common and 11, Wilkes Estate eastward 70 feet to a st property line of the SECTION 2. That the fee to the lands in the above described vacated public street right-of-way and utility easement are hereby released and shall revert to the adjacent owner as provided by law SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities in the aforesaid public street right-of-way. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. A portion of the 10' wide east/west utility easement in Block 3, Lots 10 & 11, IsTRArlol~~lkes Estates Addition, from Iola Street eastward 70', along and parallel ICES •2 to the common property line of said Lots 10 & 11, to a point 5' west of the east property line of said Lots 10 & 11. Both rights-of-way (street and utility easement) are as shown on the attached map. The subject street and utility easement rights-of-way were acquired by dedica- tion The subject 10' wide east/west utility easement is platted but contains no utility facilities. The subject street right-of-way is open on the ground, improved and contains water, sewer, and telephone utility facilities. The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objections to this request provided the ~acated rights-of-way are replatted with adjacent property and the vacated street right-of-way is retained as a utility easement for the existing utility facilities A satisfactory replat, dedicating and retaining the necessary and appropriate utility easements, has been submitted The City Plan Commission has reviewed this request and recommends that the subject street and utility easement be vacated as requested. q Recommendation It is recommended that an ordinance be adopted vacating the 4300 block of Iola Street and a portion of the 10' wide east/west utility easement in Block 3, Lots 10 & 11, Wilkes•~Estates Addition, as recommended by the City Plan Commission.
