Home My WebLink AboutOrdinance 8980 i.. ,~ _ ` "~ J ORDINANCE NO. ~D AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING THE 4200 BLOCK OF SARITA PARK, A 50 FOOT WIDE PUBLIC STREET RIGHT-OF-WAY, FROM THE WEST RIGHT-OF-WAY LINE OF A SIXTY FOOT WIDE DRAINAGE CHANNEL LOCATED IN BLOCK 82-A, WESTCLIFF ADDITION, WESTWARD 361 FEET TO THE TERMINATION OF SAID SARITA PARK; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE 4200 Block of Sarita Park, a 50 foot wide public street right-of-way, from the west right-of-way line of a sixty foot wide drainage channel located in Block 82-A, Westcliff Addition, westward 361 feet to the termination of said Sarita Park, be and the same is vacated, abandoned, and permanently closed and extinguished as a public street right-of-way. SECTION 2. That the fee to the land in the above described vacated public street right-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained. The subject vacation request is made in order to replat the vacated right of way with adjacent property and provide a private and more secure street to serve Lots 2R, 3R, 4-6, 9, 10, 11R, 12R and 13R, Block 82-A, •NSE:~Jestcliff Addition. Since the subject vacation request was made prior .to July 1, 1983, the monetary consideration policy does not apply. Reviewing City departments and private utility companies have raised no objec- tions to this request, provided the vacated right of way is replatted with adjacent property and also, retained as an utility easement for the existing utility facilities. A satisfactory replat, retaining and dedicating the appropriate utility easements, has been submitted. The City Plan Commission has reviewed this request and recommends that the subject street right of way be vacated as requested. ..--~° ~,.... ,.
