ORDINANCE NO. _~_.L~2!
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND
EXTINGUISHING A PORTION OF THE 5 FOOT WIDE NORTH/SOUTH
UTILITY EASEMENT LOCATED ADJACENT TO THE WEST PROPERTY
LINE OF LOT 1, BLOCK 1, JESSA MITCHELL .ADDITION, AND THE
30 FOOT WIDE NORTH/SOUTH EMERGENCY ACCESS AND UTILITY
EASEMENT LOCATED ADJACENT TO THE EAST PROPERTY LINE OF
LOT 2, BLOCK 1, L-M INDUSTRIAL ADDITION; PROVIDING FOR
REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES
IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE FOLLOWING be and the same are vacated, abandoned, and
permanently closed and extinguished as easements for their
respective purposes:
A. That portion of the 5 foot wide north/south utility
easement located adjacent, along, and parallel to the
west property line of Lot 1, Block 1, Jessa Mitchell
Addition, as recorded in Volume 388-77, Page 45, Plat
Records, Tarrant County, Texas, from the south
property line of the aforesaid Lot 1 northward 497
feet to a point 125 feet south of the south
right-of-way line of Felix Street Access Road; and
B. The 30 foot wide north/south emergency access and
utility easement located adjacent, along, and
parallel to the east property line of Lot 2, Block 1,
L-M Industrial Addition., as recorded in Volume
388-95, Page 44, Plat Records, Tarrant County, Texas.
SECTION 2.
That the fee to the lands in the above described vacated
portion of the 5 foot wide utility easement and the 30 foot wide
emergency access and utility easement are hereby released and shall
revert to the adjacent owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

Liberty Manufacturing Company, owner of all abutting property, has requested that
.3the City vacate the following:
(1) A portion of the 5' wide north/south utility easement adjacent, along and
I lSTRATIAq~rallel to the west property line of Lot 1, Block 1, Jessa Mitchell Addi-
tion, as recorded in volume 388-77, page 45, P.R T.C.T., from the south

ments are as shown on the attached map.
The subject utility and emergency access and utility easements, acquired by
dedication, are platted but contain no utility facilities The subject vacation
request is made in order to replat the vacated easements with adjacent property
to expand the building area and provide usable yard space A satisfactory replat.

Since the subject vacation request was submitted on April 3, 1978, it is not
subject to the recently adopted remuneration policy/ordinance Reviewing
City departments and private utility companies have raised no objections to
this request
The City Plan Commission as ~revieu~e'd'~ ~th~i~ request and recommends that the
subject utility and emerg ncy access and u~tili~y easements be vacated as

Recommendation
It is recommended that ari ordinance be adopted vacating the subject utility
and emergency access and utility easements as recommended by the City Plan
Commission.
