ORDINANCE NO . ~ ~ (~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING A 15-FOOT WIDE EAST/WEST ALLEY RIGHT-OF-WAY, A
15-FOOT WIDE NORTH/SOU'T'H ALLEY RIGHT-OF-WAY, AND A 15-FOOT
WIDE FIRE LANE EASEMENT IN BLOCK 3, UNIVERSITY PLACE ADDI-
TION; PROVIDING FOR REVERSION OF FEE IN SAID LANDS;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the following be and the same are vacated, abandoned and
permanently closed and extinguished as alley rights-of-way and fire
lane easement, respectively:
A. The 15-foot wide east/west alley right-of-way located
in Block 3, University Place Addition, said alley
being more particularly described in Exhibit "A",
attached hereto and incorporated herein.
B. The 15-foot wide north/south alley right-of-way
located in Block 3, University Place Addition, said
alley being more particularly described in Ex-
hibit "A", attached hereto and incorporated herein.
C. The 15-foot wide fire lane easement located in
Block 3, University Place Addition, said fire lane
easement being more particularly described in Ex-
hibit "B", attached hereto and incorporated herein.
SECTION 2.
That the fee to the lands in the above described vacated alley
rights-of-way and fire lane easement is hereby released and shall
revert to the adjacent owner as provided by law, SAVE AND EXCEPT that
easements are retained for any and all existing and prospective util-
ities in the above-described vacated east/west alley.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so ordained.

Texas Christian University, owner of all abutting property, has requested that the
City vacate the following: (a) a 15' east/west alley from Green Street westward
,,;,~~QAT;D~o~ a point 7~' west of the raesternmost right-of-way line of a north/south

alley in Block 3, University Place Addition; (b) a 15' wide north/south alley
NFf~rom PrincetSn Street southward .150' to the southwest corner of Lot 9, Block 3,
University P~.ace Addition; and (c) a 15' wide fire lane from the south right-of-
way line of the 15' east/west alley southward 155' to the old north right-of-way
,Yl,~+i-t~eno£yWest•Lowden Street, which was vacated by Ordinance No. 7120, all rights-
of-way are as shown on the attached map.

„I~~ie~subject alley and fire lane easement rights-of-way, acquired by dedication,
are platted,.improved, and open on the ground. The 15' east/west alley contains
G sewer, gas, electric, and telephone utility facilities. The remaining alley and
fire lane easement contain no utility facilities. The subject vacation request
.E"1FS1imade in odder to replat the vacated rights-of-way with adjoining property,
to expand the building area, and provide more usable yard space.
In the opinion of the Real Property Department, the compensable interest in the
land area comprising the east/we:ot alley in Block 3, University Place Addition,
is $4,050, which has been received and put in escrow by the Real Property
Department. In the opinion of tYie Real Property Department, the City has no
compensable interest in the land area comprising the north/south alley and the
fire lane, since these two rights-of-way were dedicated by Texas Christian
University.
Reviewing City departments and private utility companies have raised no objections
to this request, provided the vacated rights-of-way are replatted with adjacent
property, and the vacated east/west alley right-of-way is retained as a utility
easement for the existing utility facilities. A satisfactory replat, retaining
and dedicating the necessary and appropriate easements, has been submitted.
' The City Plan Commission has reviewed this request and recommends that the
subject fire lane and alley rights-of-way be vacated as requested.
Recom¢nendation
Tt is recommended that an ordinance be adopted vacating the fire lane and alley
rights-of-way in Block 3, Lots 1R and 9-15, University p~~~~~.t~Y~n, as
recommended by the City Plan Commission. CITY COUNCIL
