PERFORMING AGENCY will perforin the laboratory services listed on Attaclmient A as requested by RECEIVING
AGENCY.
PERFORIti11NG AGENCY will perform the services subject to and in accordance with Texas Department of Healdi
Laboratory Procedures Manuals, and any applicable federal or state laws and regulations in connection with the work-
required
orkrequired by this contract including the Clinical Laboratory Improvement Amendments of 1988 (CLLR),42 USC §263a.
PERFORMING AGENCY will notify RECEIVING AGENCY of the results of the tests within five(5)working days from
the date samples are completed by PERFORMING AGENCY. PERFORMING AGENCY will either electronically
transmit or mail a copy of the test results to RECEIVING AGENCY,
TERM OF CONTRACT:
This contract will begin on the date of receipt of the first specimen from RECEIVING AGENCY and terminate on August
31,_2001_. Either party may terminate this contract prior to its stated termination date by Providing the other party with
at least thirty(30)days written notice of intention to termuiate.
An equitable adjustment for any termination shall provide for payment to PERFORMING AGENCY for servi,-,es rendered
and expenses incurred prior to the termination, in addition to termination settlement costs reasonably inetrred by
PERFORMING AGENCY relating to commitments which had become Cum prior to the termination.
PAYMENT FOR_NERVICES:
PFRFORMING AGENCY will bill RECEIVING AGENCY on a monthly basis. RECEIVING AGENCY shall remit
payment within thirty(30)days after the date billing is received. Payment shall be mailed to: Texas Department of Health,
Bureau of Laboratories, 1100 W. 49th Street,Austin, Texas 78756.

MISCELLANEOUS:
This contract is not transferrable or otherwise assignable by PERFORMING AGENCY.
If any provision of flus contract conflicts with applicable law,such conflict will not affect other provisions of the contract
which can be given effect without the conflicting provision, and the parties expressly intend for this contract to be
interpreted in a manner that considers the provisions of this contract to be so severable. The waiver of arty particular
provision by either party shall not constitute a waiver of any other provision. No waiver shall be valid unless the same is
reduced to writing and signed by both parties hereto.
This contract represents the entire agreement between the parties hereto and supersedes any and all prier agreements
between the parties,whether written or oral.
Any amendments,modifications,or supplements to this contract shall be in writing and shall be signed by both parties
hereto.
The undersigned parties bind themselves to the faithful performance of this contract. This contract is exeeulod in duplicate

SUBJECT APPROVAL OF AN INTERLOCAL AGREEMENT WITH THE TEXAS DEPARTMENT
OF HEALTH FOR LABORATORY SERVICES
RECOMMENDATION:
It is recommended that the City Council:
1. Approve the transfer of $24,600 from Undesignated in the Environmental Management Fund to the
Fish Tissue Sampling project within the Environmental Project Fund; and
2. Adopt the attached appropriation ordinance increasing estimated revenues and appropriations in
the Environmental Project Fund by $24,600; and
3. Authorize the City Manager to execute an Interlocal Agreement with the Texas Department of
Health, Bureau of Laboratory Services for testing of fish tissue samples from Echo Lake, Lake
Como, and Oakland Paris Lake in the amount of$24,600. This agreement will expire August 31, 2001.
DISCUSSION:
On December 5, 1995, the Texas Department of Health (TDH) issued fish consumption bans at Echo
Lake, Lake Como and Fosdic Lake in Oakland Park after testing of fish tissue samples at the TDH
Bureau of Laboratories showed unsafe levels of pesticides such as chlordane, DDT, dieldrin, and
PCBs. City staff has monitored these lakes in the past and periodically tested fish tissue samples.
Analysis of these samples by local laboratories has indicated a decrease in the levels of pollutants.
Under State regulations, TDH can lift the fish consumption ban at these three lakes if the TDH Bureau
of Laboratories can confirm this decrease.
The City will be responsible for collecting the fish samples and transporting them for analysis. The
samples will be collected in October 2000, and results are expected by August 31, 2001.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current operating budget, as
appropriated, of the Environmental Management Project Fund.
