HomeMy WebLinkAboutOrdinance 8787.. a ~, ORDINANCE NO <.S ~~~ TEXAS: AN ORDINANCE AMENDING CHAPTER TWO, "ADMINISTRATION," SEC. 2-52.1 OF THE CODE OF THE CITY OF FORT WORTH, TO PROVIDE FOR NINE PLACES ON THE PARK AND RECREA- TION ADVISORY BOARD; PROVIDING FOR STAGGERED TERMS; PROVIDING A LIMIT FOR TERMS OF SERVICE ON THE BOARD; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES; REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PRO- VIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, SECTION i That Chapter 2, "Administration," of the Code of the City of Fort Worth (1964), as amended, is hereby amended by changing Section 2-52.1 thereof to read as follows: "Sec. 2-52.1. Advisory board; appointment of members; composi- tion; term; removal of members. "The City Council shall appoint an advisory board to be comprised of citizens to act in an advisory capacity to the City Manager and City Council in conjunction with the Park and Recreation Department The Board shall consist of nine (9) members, who shall serve in places numbered 1 through 9 Members appointed to odd-numbered places shall serve terms which expire October 1, 1985 Members appointed to even-numbered places shall serve terms which expire October 1, 1984. Thereafter, members shall serve two-year terms. No member shall serve more than three con- secutive two-year terms, and the terms of current members of the Board shall be counted toward the limit of terms to be served for purposes of this ordinance." SECTION 2. That this ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1964), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinance and such code, in which event conflicting provisions of such ordinances and such code are hereby repealed. SECTION 3. That it is hereby declared to be the intention of the City Council of the City of Fort Worth, Texas, that the sections, para- graphs, sentences, clauses and phrases of this ordinance are sever- able, and, if any section, paragraph, sentence, clause or phrase of ,~. ~~~ . a~ _ ~~ this ordinance shall be declared void, ineffective or unconstitu- tional by the valid judgment or final decree of a court of competent jurisdiction, such voidness, ineffectiveness or unconstitutionality shall not affect any of the remaining sections, paragraphs, sen- tences, clauses or phrases of this ordinance since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional section, paragraph, sentence, clause or phrase. SECTION 4. This ordinance shall be in full force and effect from and after the date of passage. Background On Marcfi l5, 1983, the City Council approved Ordinance No 8758, "Rules for _-- Borads and Commissions." That ordinance establishes nine membership places for ---~ ~-` each City board, unless membership is governed by conflicting state laws, City ~_` Charter provision or Council exception It also provided for two-year, staggered terms for board members The Park and Recreation Advisory Board is currently composed of nine members, but these members are not appointed to specific places The attached ordinance will incorporate the above provisions of Ordinance No 8758 for use by the Park and Recreation Advisory Board The ordinance also _~~~ provides that no member shall serve more than three consecutive terms. Recommendation It is recommended that the attached ordinance be adopted, amending City Code Cahpter 2, Article IV, Sec. 2-52.1, "Park and Recreation Advisory Board," establishing nine membership places and two-year staggered terms for members, and limiting members' service to three consecutive terms.
