ORDINANCE NO. ~ ,I~~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING THE TEN-FOOT (10') WIDE UTILITY EASEMENT WHOSE
CENTERLINE LIES ALONG THE COMMON BOUNDARY LINE OF
LOTS 9-R, 10-R AND 11, BLOCK 4-R, CHAPEL CREEK ADDITION;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the ten-foot (10') wide utility easement whose centerline
lies along the common boundary line of Lots 9-R, 10-R and 11,
Block 4-R, Chapel Creek Addition, and which extends from the south-
west corner of said Lot 9-R and northwest corner of said Lot 11 in a
northeastern direction 101 35 feet to Powder Court, a street, be and
the same is vacated, abandoned and permanently closed and extin-
guished as a utility easement.
SECTION 2
That the fee to the land in the above described vacated utility
easement is hereby released and shall revert to the adjacent owner
as provided by law
SECTION 3
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed
SECTION 4
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained

The subject utility easement, acquired by dedication, is platted but contains no
utility facilities The subject vacation request is made in order to replat the
vacated utility easement with abutting property, expanding the building area and
providing more usable yard space.

'S Reviewing City departments and private utility companies have raised no ob-
jections to this request
Recommendation
It is recommended that an Ordinance be adopted vacating the 10' wide utility
easement in Lots 9-R, 10-R and 11, Block 4-R, Chapel Creek Addition.
