Danny Reed re U Electric rates Mr. Corky Makar- wich,`'Sr. re TU Electric rates SPECIAL CITY COUNCIL MEETING MAY 3, 1990 On the 3rd day of May, A.D., 1990, the City Council of the City of Fort Worth, Texas, met in special session, with the following members and officers present, to -wit: Mayor Bob Bolen; Mayor Pro tempore Garey W. Gilley; Council Members William N. Garrison, Kay Granger, Eugene McCray, and David Chappell; Assistant City Manager Ramon Guajardo; City Attorney Wade Adkins; Assistant City Secretary Gloria Pearson; Council Member Virginia Nell Webber absent and Council Member Louis J. Zapata temporarily absent; with more than a quorum present, at which time the following business was transacted: Attention of the City Council was called to a notice issued by Mayor Bob Bolen for a special meeting of the Fort Worth City Council, as follows: f NOTICE (in accordance with Article 6252-17, R.C.S.) OF AGENDA OF A FORT WORTH CITY COUNCIL . SPECIAL MEETING TO BE HELD IN THE CITY COUNCIL CHAMBER OF THE FORT WORTH CITY HALL 1000 THROCKMORTON STREET FORT WORTH, TEXAS 76102 AT 1:00 P.M. ON MAY 3, 1990 The following matters shall be considered by the Fort Worth City Council in a special meeting to be held in the City Council Chamber of the City Hall commencing at 1:00 p.m. on May 3, 1990: 1. Public hearing concerning Texas Utility Electric Company's rate increase request (PUC Docket 9300). 2. City Council action concerning Texas Utility Electric Company's rate increase request. To Members of the Fort Worth City Council: I hereby call the above-described meeting of the Fort Worth City Council for 1:00 p.m. on May 3, 1990, in accordance with Chapter III, Section 5 of the Fort Worth City Charter. /S/ Bob Bolen Mayo r Mr': Danny Reed, Energy Manager for the City of Fort Worth, appeared before the City Council and presented a staff report recommending that the existing rate not be adjusted and that the rate increase be denied. At this time, Council Member Zapata assumed his chair at the Council table. Mr. Corky Makarwich, Sr., 905 Roberts Cut -Off, appeared before the City Council and requested that the City Council give favorable consideration for the Texas Utility Electric Company's rate increase. Minutes of City Council 0-3 Page 520 521 THURSDAY, MAY 3, 1990 Mr. Roosevelt Smith Mr. Roosevelt Smith, 3021 Van Holn, appeared before the City Council and expressed re TU Electric support of the increase. rate Mr. Harry Beason Mr. Harry Beason, 4025 Dakota Trail, appeared before the City Council and re TU Electric requested that City Council give favorable consideration to the Texas Utility Electric Company's rate increase request and stated that, in his opinion, the increase would only improve services already provided and better serve the community. Dr. David Estes Dr. David Estes, 3719 Camp Bowie, appeared before the City Council and expressed re TU Electric opposition to the rate increase and stated that the rates of Texas Utility Electric be rate rolled back. Ms. Betty Brink re Ms. Betty Brink, 7600 Anglin Drive, appeared before the City Council and presented TU Electric rate correspondence from Citizens for Fair Utility Regulations in opposition to the Texas Utility Electric Company's rate increase request and advised the City Council of a formal protest against the scheduling of the public hearing at 1:00 in the afternoon, preventing citizens who work to attend the public hearing. Mr. Bill Nuckols re Mr. Bill Nuckols, 1215 Britt, appeared before the City Council and expressed TU Electric rate opposition to the request of Texas Electric Utility Company for a rate increase. Mr. James R. Tea- Mr. James R. Teague, 3404 Martin Lydon, President of Senior Citizens Alliance of gue re TU Tarrant County, appeared before the City Council and presented a resolution that had Electric rate been previously furnished to the City Council in February concerning Commanche Peak Nuclear Electric Plant and proposed rate increases and also presented a supplemental resolution to the City Council urging the denial of the 10.2 percent electric rate increase sought by Texas Utility Company with respect to the Commanche Peak Nuclear Electric Unit No. 1. Ms. Denise Jones Ms. Denise Jones, 6051 Bridge Street, appeared before the City Council and re TU Electric expressed opposition to the Texas Utility Electric Company's rate increase request and rate stated that, in her opinion, a rate rebate should be given to the citizens instead of a Mr. Steve Williams request for a rate increase. Mr. Lon Burnam re e Mr. Lon Burnam, representative of Texas Citizens Action, appeared before the City TU Electric rate Council and expressed opposition to the ordinance and opposition to the rate increase and advised City Council of his disappointment in the timing of the hearing. Ms. Pamela Dunlop Ms. Pamela Dunlop, 2508 Rodeo, appeared before the City Council and expressed re TU Electric opposition to the Texas Utility Electric Company's rate increase request and expressed rate her concerns regarding the lack of minority representation in the upper management of re TU Electric Texas Utility Electric Company. Mr. Jeffrey Pulis Mr. Jeffrey Pulis, 1025 South Jennings, representing Allied Community of Tarrant, re TU Electric appeared before the City Council and advised the City Council that TU Electric rate initially filed a motion opposing an evening hearing but withdrew that motion and -requested that the City Council pass the ordinance that is before them on this issue today. Mr. Nick Kurko re Mr. Nick Kurko, 2323 Ridgmar Boulevard, representing Citizens Alliance of Tarrant TU Electric County, appeared before the City Council and expressed opposition to the Texas Utility Electric Company's rate increase and advised the City Council that senior citizens operate on a fixed increase and would not be able to afford this rate increase. Ms. Elizabeth Ms. Elizabeth Lawrence, 321 Cleveland, Weatherford, Texas, volunteer with Citizens Lawrence re Alliance of Tarrant County, appeared before the City Council and expressed opposition TU Electric rate to the Texas Utility Electric Company's rate increase request and proposed that TU Electric owes the citizens a rebate. Mr. George A. Mr. George A. Parker, 6048 Wonder Drive, member of the Senior Citizens Alliance of Parker re TU Tarrant County, appeared before the City Council and expressed opposition to Texas Electric Utility Electric Company's rate increase request. Mr. Steve Williams Mr. Steve Williams, 4316 5th Avenue, appeared before the City Council and re TU Electric expressed opposition to the Texas Utility Electric Company's rate increase request and rate advised Council that, in his opinion, any cost overruns on the part of Texas Utility Electric Company should be taken out of their own profits. Ms. Betty Hinton Ms. Betty Hinton, 5455 Lubbock, appeared before the City Council and expressed re TU Electric opposition to the time of the hearing. Mr. Gatlin Mitchell Mr. Gatlin Mitchell, 1730 6th Avenue, appeared before the City Council and re TU Electric expressed opposition to Texas Utility Electric Company's rate increase request. Ms. Fon tainethe Ms. Fontainethe Woods, 2400 Hillview Drive, appeared before the City Council and Woods re TU commended Texas Utility Electric Company for allowing its employees to provide Electric outstanding emergency service; advised the City Council that she is opposed to a rate increase; and that she would like to see more Blacks and Browns in management positions in the company. City Attorney Adkins advised the City Council that TU Electric Company has until May 9, 1990, to consider filings at PUC from people in regard to time and place of the regional hearing. Minutes of City Council 0-3 Page 521 522 Mr. Jarrell Gibbs,' re TU Electric rate Introduced an Ordinance Ordinance No. 10577 Adjourned THURSDAY, MAY 3, 1990 Mr. Jarrell Gibbs, Executive Vice President and General Manager of Texas Utility Electric Company, appeared before the City Council and advised the City Council that the company's rate in Fort Worth are among the lowest of major cities, both for residential and commercial customers; that the request is justified and an audit report commissioned by the Commission and funded by TU Electric has found that some of the expense of construction of Commanche Peak Nuclear Power Plant can be passed on to rate payers; that, in the meeting of the PUC yesterday, there will be several hearings in different areas in TU Electric Service Area and that one will be held in the metroplex area, either in southeast Fort Worth or the Arlington area. There being no one else present desiring to be heard in connection with the public hearing regarding Texas Utility Electric Company's rate increase request, Council Member Chappell made a motion, seconded by Mayor Pro tempore Gilley, that the recommendation of staff authorizing the adoption of the ordinance be approved. When the motion was put to a vote by the Mayor, it prevailed unanimously. Council Member Chappell introduced an ordinance and made a motion that it be adopted. The motion was seconded by Mayor Pro tempore Gilley. The motion, carrying with it the adoption of said ordinance, prevailed by the following vote: AYES: Mayor Bolen; Mayor Pro tempore Gilley; Council Members Zapata, Garrison, Granger, McCray, and Chappell NOES: None ABSENT: Council Member Webber The ordinance, as adopted, is as follows: ORDINANCE NO. 10577 AN ORDINANCE APPROVING RATE SCHEDULES TO BE CHARGED BY TEXAS UTILITIES ELECTRIC COMPANY IN THE CITY OF FORT WORTH, TEXAS, PROVIDING FOR SCHEDULES, CONDITIONS, SEVERABILITY; REPEAL OF CONFLICTING ORDINANCES.
